Not sure how you got that the mom dropping indictments bit since she called the police MONTHS before it went to the Grand Jury to get an arrest warrant.

Essentially the police ignored the person that filed the complaint and decided to proceed anyways.

Once an indictment is produced and sealed, the mother, or person who notified the police and claimed a crime has NO INFLUENCE whatever on the indictment. It has now become The State Vs. (Enter Indicted Persons Name Here).

IF the mother lied, she would have been arrested for filing a false police report. That didn't happen.

Essentially the police ignored the person that filed the complaint and decided to proceed anyways.

This was a grand jury, the police didn't make the call, they simply executed the warrant. The prosecuting attorney, along with the DA, made the former and final decision to empanel the grand jury. The mom made the complaint, but she had NOTHING to to with the grand jury, unless she lied to them.

Secondly, slapping a cell phone from a hand is simple assault. Not aggravated assault. In other words, a misdemeanor. There are no grand juries for anything other than felonies. Even Wikipedia makes this clear.

Misdemeanors are not presented to a grand jury, and are instead charged by prosecutor's "information." In the United States armed forces, an Article 32 hearing is used for a similar purpose. The grand jury right may be waived, including by plea agreement.

What you're suggesting is someone was indicted for the equivalent of a speeding ticket not being paid. That's not how any of this works.

The indictment was unsealed, police made the arrest. From there it was in the prosecutors and DA's hands.

The Judge threw it out for lack of evidence. It went through the entire process.

Please educate yourself on the core basics of the law before making such comments.

The mom withdrew the complaint BEFORE the indictment was even thought about. They moved forward with the indictment process even though the complaint was withdrawn.

Edit: To further clarify. The indictment was obtained MONTHS AFTER the mom withdrew the complaint.

The mom:

This is Millie’s mother … It’s my cell phone worth about $50, that she took during a family dispute that happened months ago when I was in Ohio visiting my family. She took it because I had my phone on record during an argument we were having. We resolved the issue immediately and I dropped all charges right after it happened before I left Ohio … because it was a gross misunderstanding and no harm was done.

The charges were dropped by her mom before they prosecuted Millie. The grand jury dropped the prosecutor's charges.

Also the arrest warrant was issued four weeks before she was detained, just so happened to be when she was releasing the video. So unless the prosecutor is in on Millies "hype plan" is was the government going after her to discredit her. Which it worked because I'm having to explain it to you.

Okay, after reviewing that information I think I nearly have this solved:

April 25 - Millie and mom executed phone scuffle plot with the goal of promoting her video. Mom calls 911 and presses charges against Millie.

July 20 - 3 months later, Portage County Common Pleas Court files arrest warrant.

August 14 - Millie releases "Shadowgate" video 25 days after her arrest warrant after hearing from her deepstate agents that she will be arrested later that day. Her plan is going perfectly at this point. She knows this won't distract from her video.

No, they didn't convene a Grand Jury just for her. In Ohio, each district has a Grand Jury on call most of the year to hear DAs putting cases together. In Ohio you have to get an indictment from a GJ for felony charges.

The charges were for more than the stolen phone. I just looked it up:

"Weaver, 29, is charged with robbery, a second-degree felony, tampering with evidence, a third-degree felony, obstructing justice, a fifth-degree felony and domestic violence, according to the indictment filed on July 20 in Portage County Court of Common Pleas."

3 felonies, the DA's office has to take that to the Grand Jury to indict. That's just how Ohio works. The charges are ridiculous, yes, but it going to the GJ, not so much.

When I was a grand juror I was scheduled to go 3 consecutive days a month for 12 months. 9am-5pm. They would often change the schedule on the fly but basically you are there for those times and the lawyers try to fit in their cases into a timeslots when the jurors are there. They have multiple juror groups I believe so they had some every week I believe.

Sometimes they will cancel whole days because there are no cases. Other times because things may go faster than scheduled they would fit in a extra case.

Grand Juries don't hear the whole case. They just hear "We think [this], here's the evidence, can we indict?" and the Grand Jury either agrees, or doesn't. It's not about solving the case, it's just establishing enough grounds to arrest. They only hear the DA's office's side of the case.

The court then decides if the charges are valid in a trial. That happened, and the court said "Yeah, no case here, charges dropped."

It's beyond irritating that the GJ allowed the indictment, but nobody knows what the DA's office put before the Grand Jury, and nobody will, because GJ testimony is not public record, they're sealed.

Isn't malicious prosecution a thing, though? They say that in our system you can sue anyone, but be careful because they can sue you back. I would hope that if this story is true and the prosecutor decided to go forward with the case with zero evidence that that would be indication of malicious prosecution.

One thing I would be on board for is certain liability protections for government workers, like this prosecutor, be nulled out in a case like this. That way Millie could sue her in civil court and if she lost, she'd have to pay out of her own pocket instead of using the taxpayers money.

In other words, verbal argument with her mom ending when she took her moms phone and stormed out of the room. Mom phoned it in. Parties cooled and reconciled long before police response.

Money is an interesting thing. It can help one avoid a lot of hassles in life, but in those hassles a lot of enjoyment can also be found. There is a balance with wealth that some find, and some don't. The boat, car, and vacation homes are fun things no doubt, but they don't provide happiness or contentment.

I recall early in my marriage my wife and I would go look at TV's quite frequently. LCD tv's were the new thing and we took a lot of enjoyment looking at them and trying to figure out which one we wanted, and how much to save. When we finally bought a TV, there was a bit of a letdown. We had a lot of fun dreaming about that simple item, and the process around it. When we finally got it, a we had a TV, but we missed the fun we had with the journey of getting it.

I know plenty of people who came into money at some point in their lives (some given and some earned, some young and some old) and still have their wealth and health years later. One of my friends inherited more than $50M in his early 20's. He bought a couple of businesses, opened a foundation, bought a new home and then went back to school earning a degree in marine biology which he now does as a career. Still has all that money and is one of the happiest people I've ever met.
