Not all suburban cities share the same enthusiasm and history as Waukegan. I'd call Waukegan as much a suburb of Milwaukee as I would Chicago. It's on the lake, north of Lake Forest and what is called North Suburban Illinois, which has become a huge market in and of itself, coincident with the decline of Chicago South of Skokie and Evanston. The same may be said of the communities to the west of 295. What lies between Milwaukee and Waukegan is Racine/Kenosha, cities hit hard by America's export of the manufacturing economy and the associated cultural deterioration brought about by that.

It's legal to charge both, but you can only convict on one or the other. Called a lesser included offense. The jury is generally instructed to make a finding on the shared elements, then a separate finding as to whether the additional elements of the greater offense have also been chosen.
Then why didn't they do that for OJ Simpson? Instead they shoot for a certain standard then the july wasn't convinced of that level, even though OJ was guilty as sin, so they let him go 100% free, and they don't retry because double jeapardy. So, why is this ok for a police officer who is innocent, but not ok for a guilty murderer?
OJ prosecutors made a lot of mistakes. It's not always a binary of good prosecutor/soros prosecutor. Sometimes experience and skill make a huge difference.

tl;dr: It was a traffic stop, the car went into reverse, trying to run over the policeman. The policeman opened fire, wounding the driver and killing the passenger.
