I don't see anywhere in here that would let them classify this email as a "transactional or relationship message". This would be the equivalent of the Biden campaign harvesting emails and using them for political marketing. I'm sure someone in the legal community can find something illegal about this and hit the company.

This would be easy to quantify because companies charge for sponsored sends all the time. However they only sell opt-ins.
