I lived inside the beltway for years. People in critical/sensitive positions are sometime promoted out of those positions to minimize damage. It is much easier than firing them. This is huge.

I've seen this very much. Promote to get them out of your office vs dealing with them... amazing and sad.

Any chance you have an opening at the top of your company for me?

people in a hierarchy tend to rise to their "level of incompetence": employees are promoted based on their success in previous jobs until they reach a level at which they are no longer competent, as skills in one job do not necessarily translate to another.

I know a nice but dementia riddled old man who lives in Oregon who got promoted and is allowed to incompetently do his job working for a major investigative division of the federal government from home.... because he sued them for being mean... and he won these concessions. He cannot do his job but they're afraid to fire him so he continues to get his $115k a year salary

President Donald Trump signed a new executive order that will reclassify a portion of the career federal workforce, giving agency heads the ability to hire and fire them at will under a new class in the excepted service.

The order, which the White House released Wednesday evening, creates a new schedule in the excepted service known as “Schedule F.”

It gives agency heads the authority to reclassify certain confidential, policy-making, determining or advocating positions from the career civil service to the excepted service under this new schedule.

“Placing these positions in the excepted service will mitigate undue limitations on their selection,” the order reads. “This action will also give agencies greater ability and discretion to assess critical qualities in applicants to fill these positions, such as work ethic, judgment and ability to meet the particular needs of the agency.” [...]

For me the biggest bellweather is the fact all those Arab countries are signing the peace deal in the aftermath of the debate. They would not do that unless they knew Biden doesn't have a chance in hell of winning. They would wait it out and then resume the grift if they thought Trump may lose.

Two_Scoops__ 15 points ago +15 / -0

What about the unions? Don't most of these workers belong to unions?

27
Trump2024 27 points ago +27 / -0

Not government people. Contractors sometimes. The government contracts almost 100% of the time have a clause where they can drop the contractor "for the convenience of the government". Meaning if you looked at the secretary and she felt uggy they can cut you loose.

ouvrez_les_yeux 21 points ago +21 / -0

Yeah, there are a lot of government positions that are unionized. AFGE is one of them. And union govt. employees are some of the worst. Second only to high grade employees (GS-14/15). Managers and Legal are afraid of the unions, because of the potential for litigation, and the high grades, well, they don't fire themselves.

5 CFR Part 432 covers the procedures for demoting or removing an employee for poor performance. 5 CFR Part 752 covers procedures for disciplining or removing an employee for conduct issues. The main problem, in my experience, was getting supervisors to take action against employees when there is an issue. They like to come to HR and complain about the problem employee, but when we advised them on possible courses of action to correct the issue, many times they didn't have the will to act until the situation became so untenable or upper management got wind of the situation and told them to act.

I should clarify that HR had no authority to take disciplinary action against employees. Our job was to advise supervisors on the options for correcting behavior or performance issues, and to guide them through the process to ensure it met legal requirements so our agency wouldn't get sued or have the action reversed by a third party (Merit Systems Protection Board).

The existing system works if supervisors have the will to act. Employees can be removed for something as "trivial" as being late for work 5 minutes each day. It's called progressive discipline. The supervisor might first tell the person that the behavior is unacceptable. Then, if the behavior continues, the supervisor might up the discipline to a reprimand or suspension. If it still continues a supervisor could remove the person. That's just an example. If the behavior is egregious enough a supervisor could go straight to removal. Even with the progressive approach, the process can go fairly quickly if you have a supervisor who has the will to act.

What Trump's EO sets up kind of sounds like a perpetual probationary period. Supervisors were more willing to terminate employees during the employee's probationary period (usually 1 year) because it's a easier process with a lower legal standard to be compliant. On the other hand, employees know they're on a probationary period, so for some they are just biding their time and once it's over, here comes the leave abuse (our #1 issue) and other offenses. So at least the EO will seemingly eliminate that time limit to terminate employees with the easier process, and knowing they could be dismissed at any time could motivate some employees to at least do the minimum necessary to not get fired.

But yeah, the unions are going to pitch a fit.

2
flashersenpai [S] 2 points ago +2 / -0

Unions did pitch a fit they're already quoted in the article ha

Virtually every job I've ever had contained a clause in the job offer stating I could be terminated without cause at anytime. That took away my ability to be a festering twat and still keep my job.

Bout frickin time for these fuckers thumbing their nose at the commander in chief and being a basic pain in the ass " resistance in residence".

1
Gyrfalcon 1 point ago +1 / -0

at-will employment

But large corporations get sued anyway. Building a case to terminate is complicated. Part of the reason many companies staff thru 3rd party contract houses. They can then terminate with no difficulty. More expensive short term, but justified by the difficulty of removing and being forced to rehire and pay back pay to a tort happy employee.

I believe that this Wikipedia article describes the current Excepted Service. According to the article in the post, PDJT is attempting to greatly expand the Excepted Service. (Wonderful!)

From the posted article: "Neal went as far to say it could affect hundreds of thousands of career positions, including hundreds of jobs at the Environmental Protection Agency, DHS subcomponents, the Office of Management and Budget and others." And "the Partnership for Public Service said the executive order had the potential to impact wide swaths of federal employees.”

"career federal employees"

This should not be a term used EVER.

10
M8kMdlErthGr8Again 10 points ago +10 / -0

I have no problem with the term or people who want to make a career in government.

What I do have a problem with is no real accountability for them and hard to remove for doing a piss poor job or being corrupt.

If you're not a twat, and do a good job, more power to ya.

I've worked in private industry my whole life. I'm only as good as my last days work. I can be hired or fired with as little as a day's notice. I don't understand why public servants are a protected species. I've heard anecdotal evidence of public servants doing nothing for years on end and they still have a job, I've heard public servants say "the only way I could lose my job is if I punch a co-worker or member of the public in the face". The public service should be no different, if their not performing get rid of them.

I posted about this yesterday, but the debate. :)

This is a YUGE enema to the swamp. "Protected" Fed employees can now be "at will". This is gonna pay off in huge salt chunks for a long time. All departments effected have 90 days to decide who gets covered in this...and then the layoff knives come out...

This is great.

A friend of mines old job was to analyze data for the department of energy as a contractor. His job was to check and correct data that a doe employee had analyzed. The thing was, the employees were so incompetent 99% of the time he just re-did the entire thing. Those employees could not be fired tho, so they essentially hired an entire contracting company to redo the work. This is data that does things like determine how much oil should cost.

Crap like this is why everything the government does costs 4x what it needs to and why we are trillions in debt. Fire everybody whose job isn't mentioned in the constitution and start over.

4
Winged_Splinter 4 points ago +4 / -0

Wonder if this applies to postal employees? My wife has the most difficult time trying to get rid of worthless employees. She just won a case against one that hasn't been to work in forever. Cant give too many specifics on the case, but I know she was super excited that she won. It only took 4 months...

Fuck. Yes.

I have stories. This is a very good thing.

So many gov workers are going to be piiiijised they can’t just sits around and fuck around anymore.

Most will be fine. Really. The 80% that don’t do shit... 50% of them will start working properly and the other half will get the boot if they don’t.

Seriously. It’s the 20/80 rule and it’s true. 20% do 80% of the work. There’s like 10% that don’t do shit. Of those that don’t do much work. I hardly blame them. The system was set up for them to get comfortable and have little accountability. It’s the worst thing ever for a business. But for the govt people thought I twas ok. Nope.
