I know a nice but dementia riddled old man who lives in Oregon who got promoted and is allowed to incompetently do his job working for a major investigative division of the federal government from home.... because he sued them for being mean... and he won these concessions. He cannot do his job but they're afraid to fire him so he continues to get his $115k a year salary
President Donald Trump signed a new executive order that will reclassify a portion of the career federal workforce, giving agency heads the ability to hire and fire them at will under a new class in the excepted service.
The order, which the White House released Wednesday evening, creates a new schedule in the excepted service known as “Schedule F.”
It gives agency heads the authority to reclassify certain confidential, policy-making, determining or advocating positions from the career civil service to the excepted service under this new schedule.
“Placing these positions in the excepted service will mitigate undue limitations on their selection,” the order reads. “This action will also give agencies greater ability and discretion to assess critical qualities in applicants to fill these positions, such as work ethic, judgment and ability to meet the particular needs of the agency.” [...]

Not government people. Contractors sometimes. The government contracts almost 100% of the time have a clause where they can drop the contractor "for the convenience of the government". Meaning if you looked at the secretary and she felt uggy they can cut you loose.
Yeah, there are a lot of government positions that are unionized. AFGE is one of them. And union govt. employees are some of the worst. Second only to high grade employees (GS-14/15). Managers and Legal are afraid of the unions, because of the potential for litigation, and the high grades, well, they don't fire themselves.

5 CFR Part 432 covers the procedures for demoting or removing an employee for poor performance. 5 CFR Part 752 covers procedures for disciplining or removing an employee for conduct issues. The main problem, in my experience, was getting supervisors to take action against employees when there is an issue. They like to come to HR and complain about the problem employee, but when we advised them on possible courses of action to correct the issue, many times they didn't have the will to act until the situation became so untenable or upper management got wind of the situation and told them to act.
I should clarify that HR had no authority to take disciplinary action against employees. Our job was to advise supervisors on the options for correcting behavior or performance issues, and to guide them through the process to ensure it met legal requirements so our agency wouldn't get sued or have the action reversed by a third party (Merit Systems Protection Board).
The existing system works if supervisors have the will to act. Employees can be removed for something as "trivial" as being late for work 5 minutes each day. It's called progressive discipline. The supervisor might first tell the person that the behavior is unacceptable. Then, if the behavior continues, the supervisor might up the discipline to a reprimand or suspension. If it still continues a supervisor could remove the person. That's just an example. If the behavior is egregious enough a supervisor could go straight to removal. Even with the progressive approach, the process can go fairly quickly if you have a supervisor who has the will to act.
What Trump's EO sets up kind of sounds like a perpetual probationary period. Supervisors were more willing to terminate employees during the employee's probationary period (usually 1 year) because it's a easier process with a lower legal standard to be compliant. On the other hand, employees know they're on a probationary period, so for some they are just biding their time and once it's over, here comes the leave abuse (our #1 issue) and other offenses. So at least the EO will seemingly eliminate that time limit to terminate employees with the easier process, and knowing they could be dismissed at any time could motivate some employees to at least do the minimum necessary to not get fired.

I've worked in private industry my whole life. I'm only as good as my last days work. I can be hired or fired with as little as a day's notice. I don't understand why public servants are a protected species. I've heard anecdotal evidence of public servants doing nothing for years on end and they still have a job, I've heard public servants say "the only way I could lose my job is if I punch a co-worker or member of the public in the face". The public service should be no different, if their not performing get rid of them.

A friend of mines old job was to analyze data for the department of energy as a contractor. His job was to check and correct data that a doe employee had analyzed. The thing was, the employees were so incompetent 99% of the time he just re-did the entire thing. Those employees could not be fired tho, so they essentially hired an entire contracting company to redo the work. This is data that does things like determine how much oil should cost.
Crap like this is why everything the government does costs 4x what it needs to and why we are trillions in debt. Fire everybody whose job isn't mentioned in the constitution and start over.
