How is this solved constitutionally? I hate regulation but even the founders wanted checks and balances. Should everything from banks to websites be considered public spaces after a certain point?
The problem is that, as technology evolves, innovation often requires implementation of other technologies, thus requiring more knowledge and time to produce a viable competitor.
You need more than just a good idea, you need capital.

You could argue it's discrimination based on creed.
