Actually they like to legislate from the bench because their progressive policies can’t make it through the legislative branch. They had a majority of activists judges that think the constitution is a living organisms (Scalia words) now we have a majority that will interpret the constitution as written. That’s my theory

The 30s are also the last time the Democrats (FDR) threatened to pack the court. What happened was that the Supreme Court backed down, allowed the New Deal, and then they didn't pack the court.

There was no agreement.. Only a few judges ever have been approved by a senate controlled by the other party. What happened in 2016 and now is no different than its always been done. The senate is a check on the President. When people don't like what the president is doing during their first 2 years they have a chance to make the senate put a stop on him. This is exactly what happened when we Took the Senate in 2014 and 2016. The people were telling the senate to check obama and thats exactly what McConnell did. Same shit has been going on for over 200 years
