Only after a fair trial for treason. Shouldn't take long to convict, 10 - 15 minutes max. We need a new understanding that anyone issuing unconstitutional edicts, passing obviously unconstitutional laws, or calling for abolishing the original intent of the Constitution is treason against the Constitution. That means the 16 and 17 Amendments must be reversed.

This is the tentative ruling issued by the California (not federal) judge at the trial court level:

Judges don't usually deviate from their tentative rulings, and this one was well thought out. It'll likely become the final ruling of the court.

In summary: the judge declared that a statute granting the governor emergency powers only allows him to temporarily suspend certain statutes, but not to amend them or create new ones, as that must be done by the state legislature. This was a separation of powers issue at the state level. The judge issued an injunction preventing the governor from amending or creating any further statutes, and providing declaratory relief to clarify what powers he has under this emergency statute.

For the most part, this ruling simply deals with voting in tomorrow's election. But, considering the election is tomorrow... it's kind of a moot point on that issue, isn't it?

It is currently unclear whether this ruling will affect the ongoing shutdowns and whatnot, but this statement was contained on page 8 of the ruling:

"The Govemor has issued a multitude of executive orders under the purported authority of the CESA, many of which have amended statutory law. ... The state of emergency proclaimed on March 4,2020 due to the COVID-19 pandemic continues, with no end date in sight. ... The evidence persuades the Court it is reasonably probable the Govemor will continue issuing executive orders which amend statutory law and create legislative policy under the purported authority of the CESA, violating the Califomia Constitution and the rights of plaintiffs thereunder and giving rise to a multiplicity ofjudicial proceedings, unless restrained by a permanent injunction.

Gavin Newsom, in his official capacity as Governor of the State of California is enjoined and prohibited from exercising any power under the California Emergency Services Act (Government Code $ 8550 et seq.) which amends, alters, or changes existing statutory law or makes new statutory law or legislative policy."

This is great news. My gym has been closed since the lockdowns began, with no reopening in sight. It opened for a week in July just to immediately be closed again. It's in a giant warehouse, and under covid restrictions there was only about 10-20 people in there at any given time, with masks on. It still wasn't enough

I don't understand why some states continue their lockdowns. I'm so glad to live in Florida, where pretty much everything is open and has been for months, including our schools. We have not had any big outbreaks in schools and have not had the surge in new cases all the naysayers were sure we'd get. In fact, we're doing better than CA and so many other states that are locked down and have schools closed. Not to mention, the hospitilization and death rates are significantly lower than they were in the earlier days of the pandemic.

The lockdowns hurt minorities, the working poor and lower income people more than anyone else, and of course the democrats love that aspect of it. Gotta keep people down so you can manipulate them for votes.
