If you need the court case, here’s the link!! https://www.supremecourt.gov/opinions/17pdf/16-1435_2co3.pdf

In Minnesota the Supreme Court held that prohibiting political apparel at the polls violates the free speech clause of the First Amendment!!!!

158
JimmyJam 158 points ago +161 / -3

just to be clear this is not what the case says. Don't want to give Pedes incorrect info. This ruling says that the state has a compelling interest in keeping poling places apolitical, which includes reasonable and clearly defined bans of political speech within the polling place, but that the MN law did not sufficiently define what "political" speech is and it was too broad to enforce, thus the MN law was invalid, but such laws that strike the balance of the state's interest with the individual right, are valid in principle.

72
Cstriker01 [S] 72 points ago +78 / -6

It says both:

Held: Minnesota’s political apparel ban violates the Free Speech Clause of the First Amendment. Pp. 7–19.

That’s the ultimate conclusion based on how vague the law was and citing precedent with Burnson v. Freeman

56
JimmyJam 56 points ago +62 / -6

yes but your summary is incorrect. There is no absolute right to wear political messages at the polling place. The Court specifically says that as long as the law clearly defines what is banned, and if what is banned is reasonable in enforcing an apolitical environment, then the law is valid. So without studying the 49 other state laws on poll place campaigning, it is an over simplification to say that a poll worker cannot tell you to change your clothing. In MN, if they are enforcing the law which was invalidated based on the SCOTUS decision, yes, (because it was poorly written, not because you have a right to wear campaign material at the poll) but in the other 49 states, not really.

41
Cstriker01 [S] 41 points ago +45 / -4

Yes. That’s why we are talking about Minnesota. I never stated the whole nation.

Also great work looking out for other pedes by mentioning this is just for Minnesota.

11
JimmyJam 11 points ago +31 / -20

I understand, but you are saying that the case says you have a 1st amendment right to wear political attire at the poll. And being a SCOTUS case, that would apply to all the states. The ruling never said you have a right to wear whatever you want at the polls, the ruling is about your right to have clearly defined laws, not your right to clothing choices. So yes, you are correct in the ruling's effect on MN, but not on what it establishes. It is nuanced, but important. Not trying to argue, just trying to clarify to people reading this what the ruling means.

20
Dialectic 20 points ago +27 / -7

So he’s correct in practice and you’re just being pedantic? K

13
the-new-style 13 points ago +16 / -3

The law is the epitome of pedantry

7
bananaguard62 7 points ago +8 / -1

There is a distinct difference, actually. If you don't get it that's fine, but he is right and it's worth clarifying why.

3
JimmyJam 3 points ago +4 / -1

No. There are implications for other TD members not in MN who wrongfully interpret the SCOTUS ruling.

11
Cstriker01 [S] 11 points ago +11 / -0

I won’t down vote you Jimmy! You are concerned for Pedes outside the state of MN.

A somewhat frustrating fact. Legalese becomes a fence, surrounding and isolating normal "common sense" folks, from the government and justice system that controls them. They end up frustrated when something happens to them that doesn't pass their smell test, and yet that action is very much legal.

9
45fan 9 points ago +10 / -1

SCOTUS: We aren't saying gay marriage is legal. We are saying bans on it are illegal.

Public: Okay so gay marriage is legal. Thanks Scrotus fags!

SCOTUS: We aren't saying that states may not ban political apparel. It depends what "apparel" is.

Public: Okay so political messages are legal. Thanks Scrotus fags!

13

even under the invalidated MN law, they can't kick you out, they can simply warn you that your info is being forwarded to the authorities who can then impose a fine on you.

13
glompywompy 13 points ago +13 / -0

Why? That gives exit pollsters accurate data that they shouldn't have.

Also, they can "lose" your ballot in the transition to the counting center.

Best if nobody knows. Red tsunami.

3
Current_Year_Acct 3 points ago +3 / -0

Additionally, nobody is going to think they're cool for it. Just vote, keep your politics to yourself in line. In red areas, you don't have to worry, but it's still not appropriate. In blue areas, you're just vastly increasing your chances of fuckery.

1
Granite_MAGA 1 point ago +1 / -0

The people at the box couldn't see me when I left. My town is pretty red, I didn't get any reactions walking out other than positive ones. No exit pollsters either.

exactly, i speak out and don't wear my mask and never wear it over my nose if i just want to get done with shit. it's amazing how no one says shit to me without the nose covered and barely a squabble outside of door checkers. Just take it off inside, never on nose. Most stores i can just walk in...

but today i just put my mask in like a ninja, still not overt my nose and got my vote in. That said i was impressed with lots of elder pedes not wearing there's outside in line. Where i come from that's a good sign.

41
Colorado-Living 41 points ago +43 / -2

Great job. We have the smartest voters.

31
Smurfection 31 points ago +31 / -0

No. As much as I admire this pede, and I do. In Minnesota, anyone showing up with MAGA gear is going to get challenged and it's we'll lose more cases than win because the entirety of Ellison's bureaucracy is against us. Tell Minnesota Pedes to leave the MAGA gear at home.

1
Nancypelosisoldliver 1 point ago +1 / -0

I disagree. I think you should be able to wear whatever you want to the polls. I should be able to wear my trump gear, someone else should be allowed to wear their biden gear. You should be able to wear what you want and I think any laws trying to steal your freedom no matter where you are in the usa are illegal. That goes for polling places too. I will not be controlled lmao.

Of course places might have laws saying you can't do that but then I could just claim youre tshirt is political even if its blank. Thats why I think all those laws are illegal. You have freedom everywhere. People who say you shouldn't be able to wear a trump hat to the polls are the same people telling you there is such thing as "common sense gun control" when all gun control is the opposite of common sense lmao.

Don't let anyone tell you that you have freedom EXCEPT WHEREEVER THEY DEEM NESSESSARY. Thats not how it works. You have freedom of speech always all the time this is what Twitter and reddit and instagram don't get. We all grew up knowing we are all free as long as our freedom doesn't infringe on someone else's. So why does Facebook freedom of speech have priority over my own? We each get to have an opinion by the Consitution of the United States. You should be allowed to wear your trump hat, someone else should be able to where their biden hat. In a perfect undemocrat controlled world there wouldn't even be rules like that on the books or even be a concern. Freedom, man..

22
Smurfection 22 points ago +22 / -0

Absolutely not. Although I wish the practices in Minnesota would see MAGA gear as apolitical as the see BLM gear, the fact is, anyone with MAGA gear will challenged and the election judges will gang up and throw the Trump supporter out, most likely. Do not give election judges in Minnesota a reason to challenge a voter.

I don't know what it's like where you live but Minnesota Trump supporters are fighting an uphill battle in some areas and Keith Ellison is our DA. The election judges are mostly DFL activist types. Don't give them a reason to throw a Trump supporter out.

20
kudupoo 20 points ago +20 / -0

This is a USSC decision. Maybe legal Pede has time to summarize 8n layspeach the court's finding and what it means for wearing apparel at polling places.

16
Cstriker01 [S] 16 points ago +16 / -0

Court found that the law was too vague and did not apply to voters. In Burnson v. Freeman, Scalia upheld that in Tennessee a 100 campaigning free zone was permissible to ensure secrecy of personal ballots and the process. This was cited as presidence and did not apply to individual voters as it violates the Free Speech clause of the 1st Amendment.

1
kudupoo 1 point ago +1 / -0

So, the common thought process in the country is: You cannot wear anything that shows support for one candidate over the other.

Are you saying this was completely overturned in the USSC decision.

Meaning: Regardless of which State I live in, I may go vote wearing a MAGA Hat?

2
nubfilter 2 points ago +2 / -0

In California (of all places) I was told I must remove / turn inside out my DILLY DILLY trump shirt: https://cdn.shopify.com/s/files/1/0824/6367/products/trump_dilly_-_girls_tees--black.png?v=1517848572 because it's "electioneering" to campaign for a candidate at a polling place... But I was allowed to keep my red KEEP AMERICA GREAT hat since it does not prominently show or mention a candidate.

2
Nancypelosisoldliver 2 points ago +2 / -0

I'm going to run for office and my politics apparel is going to be blank tshirts and blue jeans so everyone has to show up to the polls nude lmao

14
Smurfection 14 points ago +14 / -0

Pede, I'm really glad you did this but Minnesota pedes, do not wear any MAGA gear. It is almost certain you'll be challenged and they'll try to kick you off the grounds. Avoid the challenge and just leave the MAGA gear at home. If you see anyone being challenged and know how to argue their case by bringing up the lawsuit, and by know, I mean you have a background in law, help a pede out. However, I'm telling your right now, they are trying to throw us out if we were MAGA gear. I know the lefties are all wearing BLM gear but to most election judges, BLM gear is non political but MAGA gear is. Avoid the challenge and leave the MAGA gear at home.

2
JimmyJam 2 points ago +3 / -1

just for anyone reading this not taking your advice, even if they try to enforce the law, the law does not allow for them to kick you out, only take your information down.

6
Smurfection 6 points ago +6 / -0

You're right but don't count on election judges actually following the law in certain counties. Remember, Hennepin County found ballots in a car trunk days after the election and that's how Franken got in. So please, for today, just for today, pedes in Minnesota, especially in Ramsey, Dakota and Hennepin Counties need to just leave it all at home.

Here's how you'll know it's fraud if fraud happens in Minnesota. This is based on my many years of working in MN politics. Usually the last region called is the Iron Range...if the Iron Range is called before Hennepin County and Hennepin County is hours late (or even days like 2016), Hennepin County "found" ballots. So please, please, don't encourage people especially in those counties to do anything that could spoil their ballot or get them removed, even if the removal isn't legal. The DFL doesn't care. They'd rather be illegal and win than follow the law and lose. Like I said, it's an uphill battle in certain places in Minnesota.

13
glow-operator-2-0 13 points ago +15 / -2

MAGA doesn't promote any specific candidate.

Trump's name isn't specifically stamped on that.

Biden could've used it, but he and his party place America at spots other than #1 on their priority list.

8
Smurfection 8 points ago +8 / -0

I know what you're saying is true, but this is in Minnesota. The election judges are all heavily DFL and they will challenge any Trump supporter who comes in with MAGA gear. We need out pedes to get ballots to vote and they won't give a ballot to someone who has MAGA gear. For today, and only today, in Minnesota, leave the MAGA Gear at home and go in stealth.

1
glow-operator-2-0 1 point ago +2 / -1

11
glompywompy 11 points ago +12 / -1

6

I’m good. They are scanned into a sealed metal box that none of the poll workers there can access. It was pretty secure. I got to verify it was accepted and secured.

2
glompywompy 2 points ago +2 / -0

They can still put your name aside and hand over a list of ballots that the official counters should "lose" in the counting center.

The lock box is not secure.

4
DeafMute 4 points ago +4 / -0

I wouldn't try this in a blue jurisdiction unless I was an activist trying to litigate a specific outcome. Don't give them an excuse to mess with you. Just go in, do the needful, and enjoy the saltworks tonight.

Outside the polling place, feel free.

Have that attitude after we win, not today.
