Your probably right, but just to play devil's advocate for a moment – it's not possible to legally build and prosecute a giant RICO case concerning a nationwide conspiracy to commit electoral fraud in a presidential election, without surveilling and gathering evidence on the conspirators DURING a presidential election.

Uhh... how about that 2018 election when they committed voter fraud in the same places? Or I dunno, you could use the world's greatest spying apparatus, that sucks up everyone's emails, phone calls, private conversations (thanks Siri/Alexa), text messages, etc. and maybe search for people plotting a coup. Hell, you could even pay attention to leaked Zoom meetings talking about coups and voter fraud.

Still playing devil's advocate here – 2018 wasn't a presidential election. The 2020 election is the first opportunity since Trump has been in office for white hats to document and understand how the Dems commit election fraud during a presidential election. This may be retroactively important in proving how previous presidential elections were stolen and voiding the actions of former illegitimate presidents.

That's a false analogy. Election fraudsters aren't planning to murdering anyone, but if they were and law enforcement got wind of that, then of course they would be obligated to prevent it in that instance. Generally in RICO cases, sweeping arrests are made simultaneously after the investigation has gathered sufficient evidence against the perpetrators. Strategically it wouldn't make sense to arrest plotters in a single state or district due to the content of their messages as that would give the game away to plotters in other areas who would then realize they were under surveillance and cover their tracks.
