Apparently last week one of my coworkers called me drunk at like 1am and he asked me several pointed questions about how I feel about several issues including George Floyd and the Biden Laptop. He didn’t like the responses I gave him about those topics so he told HR that I said that I said that all muslims should be killed. HR was like... well if you actually said that then that would be hate speech but I denied saying that because I would never say that. She ended the call with saying “well i will send you a copy of the corporate harassment policy and have you sign it and maybe you should just not ever talk to him again outside of work. Also, I don’t have time for this shit”

Yea, I don't talk to family when they're drunk or intoxicated. I'd explain to them that that employee had called you, and was extremely inebriated and making false accusations, and falsifying a report.

And then still don't ever talk to that piece of shit "AT HR'S DISCRESSION" ever again. If they don't like it, they can go fuck themselves.

Also kindly point out to HR that (if you're in the US) that there is no such thing as "hate speech" and therefore, no hate speech laws, ask to see a copy of the current 'policy' with the company.

I'd then gently consider that, while you condemn such statements, they would still be protected under the first amendment, and cannot be infringed by such corporate policies, because it would be an attempt to silence your voice.

More information is needed in this case. Are they in the US even, which is a huge thing. Hate speech laws in UK/Canada are no joke and basically accused, and you lose, even if you "win" in the end by fighting it.

Yup, retaliate. You have proof (phone records) the guy called you at 1am, so it would seem he could have been harassing you as most co-workers don't call each other in the middle of the night without business need.

Doesn't really matter, the employee initiated contact, started asking jagged questions. It's entirely the other employee's fault.

Still a good policy to have not to talk with co-workers outside of work, especially when they've been drinking, (WHICH IS 100% LIABILITY OF THAT EMPLOYEE'S ACTIONS)

Honestly, I'd be flipping it on him and trying to get him fired for, assuming this is 100% accurate, for filing fake reports while intoxicated.

If he did, and he was intoxicated, it would be clear if he was purposely trying to edge him on, and that's basically entrapment.
