The challenge to the SCOTUS should be that the Constitution specifically says that Congress sets the Election DAY ....not Election week.

States cannot 'go around it' by having mail-in votes to extend the Election day. The Constitution overrides all State laws.

No "States rights" is applicable here. States have no standing.

God I hope so. If this is correct then the Michigan state legislature is genius for not allowing mail in ballots to be counted before election day. Hamstrings the amount of time they have to perpetuate this fraud.

I don't think so. I think this will be the likely scenario.

Suppose that the governors in Michigan, Pennsylvania and Wisconsin have made a final determination that Biden won the popular vote. As a result, the states’ electors plan to vote for him. But what if Trump’s supporters in Congress argue that it’s all a fraud — and that the president actually won the three states? The text of the Electoral Count Act is frustratingly silent on what would happen in that case. The Senate debates about the issue at the time seemed to suggest that Congress could ignore a final determination by the states, if fraud was indeed involved. If so, Republicans could try to find a way to swing the election to Trump. And if that is right, then we could easily imagine real chaos in Washington. – Cass Sunstein

i expect wisconsin, michigan, nevada, and arizona to be litigated. and when every ballot is scrutinized tons of dem fraud votes will be thrown out. possible litigation in NC and PA also.

gop had massive lead in early votes and mail in votes in both NC and AZ. and nevada is extremely close.

after or during litigation its to the courts. but the states trying to count ballots for an extra week need to be litigated now and halted by the courts

Shouldn't chain of custody come into play here? That would automatically invalidate whatever's counted afterwards.

It is also not very believable for them to count millions of votes, stop and then say it will take them 3 days to count 37K votes.

If people cannot show up in person to vote after election day, their ballots cannot show up to vote after election day.
