It's valid to abstain from voting. If the tallying machine doesn't reliably register sharpie marks, then it would likely just not count the vote for any candidate.
Such a machine would likely only report an error to read if it had trouble indexing the ballot, i.e. it wasn't inserted into the machine properly, or the ballot was physically damaged.

I voted in San Diego (Mira Mesa), and was given a felt tip marker.
They did this to me in NY. We almost flipped ny, even with their cheating.
