The first surge for Biden when fox called AZ on election night was definitely from mail in ballots and not election day. People that voted on election day (mostly Republicans!) were given sharpies when the mail in instructions say explicitly NOT to use sharpie.

As far as I know, the sharpies haven't been an actual problem. I'm in AZ and I was given a sharpie (fine tipped felt pen) when I voted in person. The sharpie did bleed through, but the bubbles were situated so that any bleed through would not come close to any of the bubbles on the other side. The machine came up with no errors when I fed mine through and as far as I could tell, no one else in the room with me was getting any errors at that time. We were all using the same pens.
Supposedly AZ anticipated bleed through with these pens and made sure ahead of time that it wouldn't be a problem for the machines (errors or misreads).
I'm not sure why they are taking so long to finish counting the rest of the votes here though. Sure hope we flip red. If Trump keeps GA, PA, and NC... and then AZ flips red... I will bask in the liberal tears as they curse my state for the next 4 years.

Then they stopped the count, and began counting again early the next morning, giving Biden the lead. Somehow they "found" over 100K votes for Biden, without a SINGLE one being for Trump.

Show me the Supreme Court ruling that says ballots received after 12 am on the first Tuesday of November every 4 years are legal and should be counted.

Technically only Congress can set the date for an election, which they have set as the 1st Tuesday after the 1st of November. It's not within states rights to extend the receipt of ballots beyond that date. SCOTUS should give a favorable ruling.

All depends on how the SC comes down. Do they err on the side of "too late to do anything" or "this is highly suspect and therefore all the votes must be spoiled." I know how I'd vote, but that's a big decision. Not really a clear answer, IMO.
The Constitution is crystal clear on it, though. It unambiguously states that the State legislatures shall have the power to set the dates and times of elections. In every state being contested, the legislatures' laws are being openly, brazenly violated. The hubris is nearly as criminal as the actual felonies.

Bingo - if a state is working through a backlog of votes that were submitted/arrived on election day that’s one thing (and in fact normal), but this bullshit of trucking in tens of thousands of ballots in the dead of night the next day has no legal basis to be included in the count, and should be challenged in court. 3 U.S. Code § 1 says so. The election was OVER on Nov 3rd. The onus falls on the USPS which said from the start there's no way they could hand mail in voting. The legal Presidential election ENDED and no votes arriving AFTER election day can be counted as a legally certified vote. In Maricopa County AZ it sounds like places with scanners used Sharpies, while those with no scanners used ballpoint pens.

Technically only Congress can set the date for an election, which they have set as the 1st Tuesday after the 1st of November. It's not within states rights to extend the receipt of ballots beyond that date. SCOTUS should give a favorable ruling.

The Constitution is crystal clear on it, though. It unambiguously states that the State legislatures shall have the power to set the dates and times of elections. In every state being contested, the legislatures' laws are being openly, brazenly violated. The hubris is nearly as criminal as the actual felonies.
But it's hard to prove without poll watchers there to witness it. They're doing everything they can to prevent evidence from being created. Hopefully, we have enough when the dust settles.

Bingo - if a state is working through a backlog of votes that were submitted/arrived on election day that’s one thing (and in fact normal), but this bullshit of trucking in tens of thousands of ballots in the dead of night the next day has no legal basis to be included in the count, and should be challenged in court. At the very least they should be sequestered from the rest of the ballots until they undergo judicial review.
IMO voting should stop immediately after election day. Even if someone mailed in a ballot a month ago and it hasn't been counted it yet. Too much wiggle room for bullshit if counting continues after election.

3 U.S. Code § 1 says so. The election was OVER on Nov 3rd. The onus falls on the USPS which said from the start there's no way they could hand mail in voting. The legal Presidential election ENDED and no votes arriving AFTER election day can be counted as a legally certified vote. This is our Constitution and the states can not usurp that for there own reason.

It is 100% true - the constitution is very specific the the electoral process for selecting state electors MUST take place on the first Tuesday of November. It’s ok if states need to take a day or two to count those votes but the ballots themselves must be received on election day to be deemed Constitutionally valid.. This applies not only to votes trucked in the dead of night the next day but also stuff that arrives in the mail after election day (especially now that there is evidence that some people at the USPS were tampering with postmark dates).
