Our Federal Election Commission has no quorum and cannot make any decisions or rulings with only 3 out of 6 people. All he would have needed was approval from the Senate - just like SCC but way less scrutiny.

Trump updated his replacement list a week before they announced her death. I think that was a signal that he knew, so they finally came out with it.
