Depends on the courts to decide whether they get tossed or a new election occurs. You prove in a court of law that the law was violated. You petition for a redress of grievances -- in this case, Trump can ask that their either disallow the illegal votes or throw out all the votes altogether.
This is how you get justice.
Throwing people in jail overnight is nothing. It's just an inconvenience for them.
That said, afterwards we can put people on trial for breaking the law, but right now, we need to win the election.
If a state can't get their act together before the December deadline, then they don't send an envelope to congress, and they don't count.

Every ballot must have a chain of custody. Just like evidence for a criminal case.
For example, police take evidence from a crime scene. They bag it, tag it, and escort it to the evidence room in the precinct. That’s the protocol. If a police officer decided “Hey, I’m tired. I’m going to take the evidence home with me. I’ll bring it to the precinct tomorrow” it taints the evidence.
Same goes for ballots.
And if they did that, Trump would ask for a remedy. He can ask that they discount a certain number of votes, or that they throw out the entire stack, or that they hold another election in the tained district.
Likely, he's going to ask the courts to deduct a certain number from Biden's count.

When a court says "Do it" and you don't, you get cited for contempt of court, and there is serious prejudice against your case.
IE, if you were ordered to produce phone records, and you instead destroy the records, the court can assume that the records were as damning as your opponent says they are.

It’s not a matter of enforcement. If you don’t comply with a court order, you default and lose the case. Your opponent gets what he is seeking.
So, if part of the lawsuit was “tossing out 500k PA votes” and the SC says “well, ok. Let’s inspect them first.” Then PA doesn’t take a step to produce them, the SC will say “Ok, you’re in contempt of a court order. I find for the plaintiff (Trump). Toss those ballots.”
There are very few valid reasons to be in contempt here. The only reason I can muster is they have no idea how to produce what the SC wants without blowing the lid off.
