Ya I think they main part of the legal side is to throw a bunch of shit at the wall and see what sticks. If something does. It will get held up in courts and they won't be able to move along with the electoral process
I'm at the point where I think the fraud was so massive, so blatant, that it will be impossible to discard enough ballots to flip. There will be enough "reasonable doubt" spread around that it will be like trying to find needles in a haystack.
The lackluster and half-hearted shit coming from Trump lately doesn't help, nor does Pence disappearing.
Trump's team probably anticipated (as an example) having to fight over 100,000 fraudulent ballots in a county after election, rather than a million spread across 50 fucking counties.
Courts have power to throw out the ballots, or the results of that state election as a whole
Ultimately state legislatures have to decide who to send as electors and have them meet by Dec 14th.
Most of the time they decide based on the results of the election.
If the results of the election are in question, or have been thrown out, then it is up to them to decide what to do
SCOTUS can literally say this states election needs to be redone? Or say these 200k votes were illegal and do not count?
Do the legislature have to vote based on their state? Texas went republican, so they have to vote for the republican candidate? What about Pennsylvania? If it’s questionable after votes are removed, who do they vote for?
the legislatures can do whatever they want. the power ultimately rests with them. many states have made laws saying that they will award electors based on the results of their own election. but given that they are the law makers, they can change the law to provide for the exception.
and then once the slate of electors have been chosen, there's no recourse for them deciding to vote however they want. eg. if this gets down to december 8th and electors are chosen for biden, and then it comes out that biden and kamala have spent the weekend throwing babies into volcanoes, or robbing banks, or whatever else, such that the electors change their mind, they can vote for trump in the electoral college, or whoever they want. some states have a punishment for voting contrary to what they said they would, but it doesn't change the vote.
most electors vote the way they say they will, and they are chosen because they say they will respect the will of the people of their state and the legislature in their vote in the electoral college.
my predictions:
MI - legislature orders hand recount, trump wins.
PA - SCOTUS throws out all ballots counted after 8pm, trump wins. OR SOCTUS throws out the election all together, and given that a new election cannot be done quickly, recommends with all effort to the legislature that the fraud in the election be considered heavily as a factor in how they choose electors. trump wins.
