I'm a lawyer, I hang out with lawyers and I shitpost here.
I'm not an election lawyer but I have friends who are, and I consulted with them over what the next steps are regarding the election.
Most of my network are Florida Bar and the defenses were most targeted there to defend against the steal.
From my conversations with them, they feel confident that PA, NC and especially fucking GA is going to an audit or votes counted after 8pm EST Nov.3 will be tossed out if not outright an entirely new limited vote is called there.
Any indication of a timeline? Or at least the path? If a federal case is filed tomorrow, will it start in a district court and then go directly to SCOTUS on appeal? Any chance that similar cases will be combined into one larger case, or would a ruling on PA be used as precedent in other cases so SCOTUS would not take up an appeal?
I'm not a lawyer. I only know the basic federal court structure and assume that these will at least get fast-tracked if not even skip directly to the Supreme Court.
Election law is not my particualr arcana but going through ConLaw/CivPro notes, SCOTUS should have original jurisdiction over this issue and not go through a song and dance at every state.
They would have to fast-track it. Elections are incredibly important (one of the most important things in our country) and there is only so much time between now and December 14th.
Imho its the most "fair" remedy but I don't do enough of this area of law to guess and I believe this is such an extraordinary situation that all remedies are on the table.
How is it fair? They've massively cheated and got caught. They shouldn't be offered a redo. The pool of ballots they poisoned should be disqualified, end of story. Disenfranchised voters should direct their ire and lawyers to the Democrat party and the election in 2022.
We need to prove these things to a certain standard.
Rudy Guiliani is an idol of mine. I would have wanted to work for him in Greenberg Traurig but the Trump Presidency happened. I trust GEOTUS and I trust Rudy.
What in the flying fuck are you talking about? The Supreme Court cannot amd will not order a new election. This is the dumbest shit I’ve ever heard.
The case - I’m not even sure what case this dumbass is referring to anymore - is not being heard by the Supreme Court immediately. Each state will have their own suit or possible multiple suits. Each will then wind its up the ladder from there to ultimately be heard by the Supreme Court if in fact it gets there.
It's happened on 2018 in North Carolina for a limited instance and may happen again.
Florida, 2000 had the SCOTUS sit in and tell Gore to sit down. Again, an unprecedented situation.
It's clear that this is an unprecedented event thus all possible remedies are on the table. You want a direct analogy which is impossible since this is an unprecedented event.
You lied to me and to everyone here by claiming you are an attorney when you can't even advocate or create a legal argument or form an analogous construction to an unprecedented event.
Seems very unlikely, they would have to hold a new vote for all offices on the ballot, not just president, and the USSC will be looking for the most limited relief possible consistent with the law as they hate to get involved in deciding elections

I think it will be fast tracked.

I bet if it gets in front of a lefty judge he/she will try to slow roll it.
Just look at what Sullivan has been allowed to do.
I hope I’m wrong.
That's good news. I'm going to be so impatient!
Thanks!
More lawyer Pedes need to be posting on here. We understand it's a legal process from here out. But getting an in depth explanation be nice to read.
Especially if mods sticky them.
I'll talk to some friends who are more familiar than I to post here about it but for obvious reasons, they're all a bit busy.
Do you think a new statewide vote is likely?
Don't know.

We haven't proven they cheated yet.

Most fair remedy?

Too much shenanigans in play for all states in question. All states may be brought to court by the Trump administration.
I hope so!
