I think they want to make sure it sticks... I watch a lot of Viva Frei on youtube and the one thing I learned from him is that you gotta get your court documents right before submitting. It doesn't matter if the irrefutable proof comes today or tomorrow, the fact that we have it is what matters. Now we just need to get the right terminology on paper to make it stick.
And a preponderance of evidence. More shit keeps getting revealed. More evidence makes the case overwhelming and less likely to get knocked down. They won't go to SCOTUS unless they have to.
