Post mark on the ballot is irrelevant, per the law written last year by the PA legislature. The PA supreme court changed it to the post mark day of election and received within 3 days. So if SCOTUS overturns what the PA supreme court did, that means ANY mail in ballot received after 8pm on election day is null and void per the law.
I believe the PA Supreme Court added the 3 days to the law when they ruled on the case, but that's not how the law works (needs to be approved by congress, senate and governor). I believe this is what they'll be arguing at the federal Supreme Court level.
My concern is whether SCOTUS will accept to hear the case and whether they will rule that the extension was unconstitutional.
I'm not concerned about roberts, but about whether he'll try to convince ACB, Kavanaugh, or Gorsuch to follow his lead (i.e. "The court shouldn't be involved in elections. We're gonna get so much backlash")
Where I voted, they stamped the envelope with the ballot inside. My understanding is that when they count the votes, they discard the envelopes. If that's true, it's going to be impossible to determine when the late arrivals came in, unless they're complying with Justice Alito's order to separate them.
Here is the problem we face. The SCOTUS has already ordered these ballots to be separated from the rest, and I don’t see how SCOTUS won’t rule that they are invalid. However my understanding is that these ballots alone are not sufficient for Trump to “win” PA, whether that has any impact on the decision of the court to hear the case is up in the air.
Election officials in parts of PA completely ignored this ruling and mixed these ballots in with other ballots. How do you determine which ballots to pull back out? Also this, at this time, does not include ballots that were then backdated to show that they were received late. Is it possible to prove which ballots were backdated?
At this point I don’t know that you can un-fuck the election in PA. In other countries this would lead to the election being spoiled and discarded and a new election being held and highly monitored. I just don’t know that the SCOTUS is going to go that far, are they willing to completely throw out a Presidential election in an entire State?
I heard a newsmax commentary that brought up something I didn't think about and has me worried. Voter disenfranchisement. Yes what PA did is 100% illegal per their state laws however, invalidating votes after election day runs the risk of disenfranchising voters when they followed their state's instructions. Is it possible the SC will see more harm in invalidating votes even when illegal? That f'n mustard seed has really had me thinking. Please explain to me that I'm wrong...please.

So if the SCOTUS allows those ballots received after the deadline and mixed in (not segregated) to stand and remain part of the final count, what is then the remedy for the legal ballots from citizens whose votes are disenfranchised by the illegal ones that came in after the deadline?

Election law in PA dictates that this is illegal. No legislative vote to modify that prior to change that so high.

If the law is followed, highly likely they will be disqualified. By the letter of the constitution and state law, they are illegal votes
