There are several different dates. Each state has their own deadline, but the federal Electoral Count Act specifies the "safe harbor" date for certification of EVs -- which is December 8, 2020.

A state can still certify EVs after that. But, if they meet the safe harbor deadline and follow their legal process, Congress cannot challenge it during the EV count in January.

If certified after the safe harbor date, a Congressman or Senator can submit a challenge. If the state doesn't follow a legal process, they can also challenge. Pennsylvania in particular could be interesting, as they ignored an order from SCOTUS prior to election day to segregate the ballots that arrived late. There are lots of legal questions in both PA and WI.

But, the challenge process probably won't help Trump. The House and Senate would vote separately whether to accept PA's EVs. Even presuming that Republicans would vote against it (a very narrow majority at the moment, and I think only one squishy RINO could block it), the tiebreaker vote would go to the PA (or WI) governor, and you can guess how that would turn out.

I'll reiterate that this is during the counting of EVs. This is a process that must be completed before it could be determined whether either Trump or Biden have a majority of EVs (and potentially put the election in the hands of Congress).

If there are issues with the electors sent to congress on the 14th, we enter a Constitutional crisis.

My take months ago was that regardless of the election outcome, the commies would cause a stink with electors on the 14th to throw the whole process into complete chaos.

I'm betting win over 270 prior to Dec 14th, but some swing States will still send democrat (communist) electors to gum up the works.

California has 55 representatives. 35? Are Democrats and 20? are Republican. Therefore the state has a Democrat delegation. Each delegation gets one vote.

There are more representatives total from blue states, but republicans control more states. California and Wyoming have the same power if it goes to delegations.

If the courts fail the system with massive evidence of illegality and voter fraud and election Fraud by officials in certain states then it’s the state representatives duty to not certify at all and send no electors or choose the rightful electors (Trump). Wasn't the left banking on the electors themselves to flip? We're talking about something else entirely. The state legislatures decide which electors to send. So there's nothing stopping a state legislature from a stolen state to say "fuck you Joe" and send Trump electors to the electoral college. Granted it depends on how the state constitution says they're supposed to pick electors (I think in PA it's based on the popular vote) Also I'm not particularly banking on this because even though the legislatures in the swing states are Republican it would take a level of cajones to do that I don't think Republicans are capable of having.

However I agree that I don’t expect the legislatures to just go ahead and do it- I suppose my opinion is that if it’s the right thing for the electors to vote Trump they’ll be able to prove that he won the states in court. The legislature would say, “all of our electoral votes go to this candidate”, or “fine, we’ll give six of our electoral votes to this candidate and four to the other.” In 1788, only three out of eleven states (Rhode Island and North Carolina hadn’t yet ratified the Constitution, and thus were technically not part of the Union) held popular votes to allocate electors, iirc.

Every state currently relies on the popular vote to appoint the electors (Nebraska and Maine have a slight variation).

The state legislature MAY get involved if there is a disputed result that cannot be resolved by the safe harbor date (2020-12-08). But, I don't think any state allows the state legislature to override the popular vote.

This is enshrined in state law. Ignoring the law is a leftist tactic... don't fall for it.

The Senate majority leader was not the one quoted in the article. So I don't really care what Corman said in September when they were talking hypotheticals. We now have a real-world situation where the law was broken and votes were counted that arrived after Nov 3rd at 8pm. If these ballots have been comingled with other ballots and the legislature feels that the election was not run fairly, then they will make that decision. I understand what the PA law says, however, the constitution gave the legislatures the power to choose the electors. The PA law may be unconstitutional under the Supremacy Clause or there may be other ways to circumnavigate the PA law. All I am saying is it is on the table and we should use it if we can. I'm not sure why you are going from thread to thread concern trolling.

I’m conflicted about this. On the one hand, they’d probably do a bang-up job because they probably have a lot of experience dealing with voter fraud and election integrity in countries we’ve attempted to democratize, like Afghanistan and Iraq. On the other, it would make it seem to some (mostly libtards, but also probably some in the middle) like the military is taking sides in an American election, which is what stops us from becoming shitholes like Mali. (A few months ago, Mali’s twice-democratically elected president was ousted in a coup by the military, which is currently ruling the country under the leadership of the general who lead said coup.) I’m not saying it would be a coup, but some people in the middle might be alienated by it and it could start the US on a very bad slippery slope.

Someone from the campaign or an influencer close to Trump needs to come here and do this. The Campaign can get thousands of people to line up in the dark for hours just to get a glimpse of the President.

Until they take control of this motivated but aimless grassroots army, it's potential will go on wasted. Your best bet to actually organize us aside from big name personalities in the movement are the mods.

But it's gotta be one of those types to do it.

Remember, our job was to vote, donate, and try to convince those close to us to do the same.

We did it, and we did it alot.

So now it's time for the legal team to take the ball and run with it. While they do that we need to keep our eyes and ears open to anything that may help them. But ultimately while the political solution is pursued, there isn't much we can do. If that fails, then it will fall back to us in a helluva way, but we're not there yet.

Sure we could help them if they would come on here and let us know how, but that's on them to use us. Not the other way around. People want to be active because it helps you feel like you are in control, and you should. But right now we need guidance from the campaign to make sure our efforts are working in concert with theirs.

Otherwise we end up looking for watermarks on ballots and other BS that doesn't actually help them.

The state's governor is required to deliver the "certificate of ascertainment" to electors before they cast their vote.

If there's a "controversy" or "contest", the certificate must explain how it was resolved. This is supposed to provide Congress with the info they need to decide whether the EVs are legitimate.

Don't forget about December 8th! States are required to settle any and all disputes about the electors 6 days before the electors cast ballots. My understanding is states must meet this deadline or Congress has the right to not accept that state's results!

Spitballing here, but I think this take has credibility.

I think the Dems planned to cheat, but I don't think all the efforts were coordinated. I think you had individual blue-haired Xims and Xers harvest/destroy/lose/create/chuck ballots, state level partisans having mail-in ballots created in response to Trump's vote tallies in the 11th hour (and in a panic, did not select any down-ballot votes in some states), and the big deep state flipping votes via the machines based on their targeted percentage or whatever algorithm they used. If the Biden campaign was in on any of them, it was likely that one.

I think the huge turnout for Trump actually caused these independent sources of fraud to panic and start overshooting each other, which made the fraud obscenely obvious. Normally when these three independent groups cheat, they do so on a much smaller scale which makes it that much harder to detect.
