Partially true. Sometimes criminal activity does not have proper punishment (like in some states child abuse). Some people do not have a gun because in many places you need a million dollars to begin to defend yourself.
Not a lawyer, but I think that whistleblowing allows you to violate NDAs.
Enron had NDAs, too. Those don't apply here.
