The only flaw I see with Dr. Shiva's analysis is that he's not doing a regression analysis, or at least that's not how he explains his results. If you were to do a regression analysis you'd have to check to see if the residuals have a pattern as well (Fraud?) or if they're normally distributed (Fraud is unlikely).
