This is the first time I've sat and watched/listened to a court hearing that wasn't required by my MBA. I'll say upfront, I have a bias towards Kallman's claim for injunctive relief. With that said, his arguments and responses were clear, crisp, and tied heavily to constitutional law requiring an audit and the authority of it versus statutory law in regards to a process audit. The defendants were clearly trying to tie the constitutional amendment to a statutory requirement to say the law is already prescribed and doesn't back Kallman's request. I think Kallman did a great job not only dismissing that correspondence but explaining to the court why that wasn't the case. You can also tell Kallman was swinging his big balls all over Fink's face based on the number of times Fink made stupid faces when Kallman's points clearly refuted his.
The judge clearly focused on the legitimacy of Kallman's claims, but it was good that he did because Kallman made a great case as to why the statutory requirement for the process audit is not the same thing as the constitutional amendment requesting an audit. I never know with judges anymore. Seems to be if they were appointed by a Democrat, they don't give a damn what the law is or the case you make. So who knows how he'll actually rule.
Yes, I do believe this will end up in the MI supreme court at least. My gut tells me Judge Kenny will rule against Kallman, which will prompt an appeal to the MI court of appeals. From there, regardless of how the appeals court rules, either Kallman or Fink (and the other defendant attorneys) will request that the MI supreme court reviews the case (which I believe is through a writ of certiorari, but not 100% sure if a writ of certiorari only refers to the US Supreme Court versus a state Supreme Court (can any lawyer pedes confirm this)?
This is true actually. I don't have the link but Robert Barnes describes it this way:
If appointed by Obama, purely political decisions the law be damned. They look for any and every clever and legal way to swing for the dems, and that is just to begin. They often go way beyond that.
If apointend by Bush Jr., they are kind of down the middle, could swing either way.
If appointed by Trump, they rule on the letter of the law.
It is absolutely despicable to the degree that the judiciary has been politicized.
I guess it depends on who appointed them and how much the president was on the take from the globalist cabals. We know Bush Jr. has some globalist relationships, which may explain why some of his justices are solid and others are worthless hacks.
Thank you for your break down of this. I watched it earlier and ended feeling that the judge was leaning towards "fuck you, get out of my court - I don't want to touch this with a 10ft pole." After a quick review, I much prefer your presentation :)
I didn't say physically go to court to hear oral arguments. I said sat and watched/listen to a hearing (which you can do online). In my MBA program, we had a class called Business Law, Compliance, and Society. As part of that curriculum, there are business topics that delve into constitutional law. Our professor did require us to listen to oral arguments from the supreme court on business-related cases as well as watch arguments (non-supreme court-related) to get a sense of how and when businesses were confronted with constitutional law. I'll be honest, this was the class where I ended up with my lowest grade in the program (an A-), which broke my 4.0 :(
Then off to SCOTUS! They knew they were going to play a massive part in this election so if this challenge shows up on there door step it should not be a surprise.
Wrong. He was not arguing for a PROCESS audit, which is guided by MI election laws. He was arguing for a BALLOT audit, which is a new right enumerated in the MI Constitution, amended in 2018 or 2019 I think.
And they were trying to conflate the two to make it seem like he had to wait until after it was certified at which point they would told him to get bent because he needed to do a ballot audit before it was certified. Commie scum always tries to undermine you.
From his website—“ He has been the primary attorney utilized by the Home School Legal Defense Association (HSLDA) to represent their members in Michigan. He has handled hundreds of home school cases and was the trial attorney in the DeJonge case, which resulted in a Michigan Supreme Court decision in favor of home educators teaching their children without excessive government regulation. As a testament to his belief in home education, he and his wife homeschooled their two children through high school graduation.”
Wow, that is fucking cool. We have homeschooled all of our kids and we are a part of the HSLDA...or at least we used to be. What a great Human Being this dude is.
I haven't tried that module, but hear good things about it. My current love is P-47 just doing basic dogfights or pattern work. Intercepting bombers is fun as well.
Don't be so negative pede! I watched it and I thought the judge was pretty receptive to Kallman's arguments. When someone is making claims, especially under oath, it's reasonable that the judge prod him a bit to make sure he isn't talking out his ass.
I am originally from Michigan and knew him and his dad (who was a judge - James Kallman) back in the 90's and early 2000's. GREAT guy, GREAT attorney. I can personally vouch for this guy - 1000% legit, tough, and super-smart.
Probably for the same reason the Donald runs buttery smooth. Do you rmemeber the first week on here and how shocking how much faster than reddit it was
almost done watching right now. He's killing it. They got the affidavits, the statute, and the solution all laid out. I can't see how they deny it unless the judge is bought off which is a possiblilty. Then they will appeal it on up the line to the U.S supreme court if necessary.
This guy is the real deal! Watched his interview on War Room this morning, and the guy was just ready to go to work! Been practicing law for 38 years, and is a lawyer for the people.
he was great. that other 2 democrat was committing treason against USA.
but they hate USA, so.
Hero! Give the man a jacket!
Hot Damn! David Kallman is a Great American Patriot!

Question:
Is this the kinda thing that will end up in the supreme court?
100% yes.

Oh I meant US Supreme Court. Or is destined to stay in state?

Can anyone give a summary of how it went? Most importantly, did he “win”?
Agreed.
The judge will give his answer Friday by noon
Then off to SCOTUS! They knew they were going to play a massive part in this election so if this challenge shows up on there door step it should not be a surprise.

I'm just repeating what he said in the ZOOM call. :)
I hope his family and loved ones are safe, and kept safe.

That’s fine - will end up with the SCOTUS either way anyway.

Kallman was swinging his balls all over opposing counsel.
This was awesome to watch honestly.
So I’d judge rules against them, do they appeal to the next court up? Or is it dead?
YES!!! I watched this yesterday and (not knowing much about law) wasn't sure if it was looking good for him.
On a scale of Hawaii to Michigan, how great is this judge!

It is excellent that people basically unknown to most, are acknowledged here, during this extraordinarily intricate timeline. Thanks for doing it
