There is where my knowledge breaks down a bit in regards to the procedure of a case moving from a state court to federal court. In this hearing, Kallman was arguing on behalf of the MI constitution and the constitutional amendment that gave the people the authority to demand an audit. I believe that they would have to start a different case with the argument being that Article II of the US Constitution was violated in order for it to move up to the US Supreme court (which I believe is a legitimate argument from what I've read and seen).
