Look up "adverse inference", its a real legal concept. It basically states that if specific evidence is deemed missing or destroyed under suspicious circumstances, you are legally allowed to assume that it leads to the worst possible outcome.
It doesn't matter, regardless of the result of the elections, half of the country is going to think that the other half cheated. A complete election system overhaul is needed.

This situation is a bit of a mess because it is multijuridictional. There are filings in different states under different state laws, using different legal arguments. BUT, generally speaking the idea here is to convince a judge that a wrong has been committed (against the voters) and to ask for 'relief.' The wrong(s) need to be sufficient that they actually affected the election (most Judges will say 'I'm not going to create a huge mess for a handful of stolen votes), then the relief needs to be 'appropriate'. Relief could be (depending on the evidence presented, and the state laws): Recount, Vote Audit, Disqualify certain ballots, Election re-do (there is some precedent for this in smaller elections) or ... Beyond the court-system, We could ask the legislature (in PA for example) to not certify the results (due to fraud), or even to appoint electors for trump.
Each battle is different with different judges. I've reviewed the pleadings for MI and PA, but I do not know what is happening in the other states legally speaking yet.
There are two campaigns happening simultaneously, the legal campaign, and the public opinion campaign, they are actually both critical. I could opine further (or even do an AMA) if people are interested.

The only explanation for a already vote cast, is someone used her name to enter a vote assuming she would not vote in person and woukd mail in her ballot. She would never realize that they would throw it out as a duplicate. So she checks her record online and it shows she voted and ballot was received. Yet, it was someone else who actually casted a vote in her name.
They are on full crisis management mode. It didn't go they way they imagined it would. They fully expected Trump supporters to fall in line because "Even Fox said it".
Instead they are being punished hard and it's hurting. Therefore they had to reverse course, they are being forced to.

In 60 GOP counties, they followed the law and did not open the ballots (and were unable to get voters to fix their ballots).
Think we'll need to have a 'big one' argument (dominion rollovers), these smaller things we hear from NV (or that I've heard so far) won't add up fast enough. But the amount of fraud in MI is preposterous, just scroll through the complaint and skim the allegations near the front of the document (https://www.greatlakesjc.org/cases/costantino_v_detroit/), it sounds like the Detroit vote precincts were run by the mob. if hundreds of thousands of votes are potentially fraudulent then that should permit an injunction to prevent vote certification until more investigation is done (emergency injunctions at this point are mostly just asking the state not to certify the vote). Enough ballots in PA may be easy to throw out because so many of them were obviously late (hopefully that is our easy-win state).
