If so, they will have to do something to prevent fraud. Maybe this needs to be done every year until it costs more to keep fighting it than the savings associated with using computer ballots.
Remember the case isn't likely to fall under criminal but Civil law. So instead of having to prove beyond a reasonable doubt it will be Preponderance of evidence or clear and convincing evidence. Which are standards that with the evidence we currently have we can prove.

It would be a criminal case if they were claiming a specific individual(s) or organization(s) or entities committed felonies or misdemeanors.
And the victim isn't a party to the action. The government would be.

If they were told to use sharpie, but weren't supposed to, those votes would be counted. If voters were told to violate the law I'm not sure how that would fall. It would've the poll worker or election office advising people to break the law, but then you have to determine intent of the voter.

Its hard to pretend the election is legitimate and shouldn't even be looked at all into, when there's a ton of lawsuits coming, claims of fraud, video of much shadiness and record numbers of votes for both supposedly, with a half year of violence leading up to the election. Any lawsuits at this point I think help.
My guess is they are going after the ballots delivered after 8pm which is in plain black and white in PA law. PA should be the easiest to flip in my honest opinion followed by a tie between GA/AZ maybe with AZ being slightly easier.

The court is not going to throw out 1.2 million votes unless they are 110% sure they were collected fraudulently.
I have a feeling these suits are designed to be defeated so that they can reach the SCOTUS as fast as possible.
