This case was appealed to the 3rd Circuit, which agreed with the District Court except as to the remedy. Rather than declaring the Republican candidate the winner, the Court of Appeals said that the proper remedy was to invalidate the election and either order a special election or leave the seat unfilled (it was a one-year term). Either way, in a presidential election there isn't time to conduct a special election, so once the election is invalidated the state legislature would decide how to award the electors.
