IMO, I think they want to explore every option to win the election first starting with the least invasive (courts) and ending with the most invasive (Insurrection Act)... if they can win it in the courts rioting will probably be less severe than invoking the Insurrection Act... bottom line is, Trump will have a 2nd term and 100s if not 1000s of people will go to prison and hopefully a select few will be executed for treason
There was more than one type of fraud used in this election, and different types require different evidence. We have different jurisdictions (States) with different applicable laws, as well.
