I have a feeling that no matter what the law actually says, the judges are going to ignore it and rule based on their feelings instead.

If a case gets thrown out, that's just the start, it gets appealed and advanced for a 2nd opinion. Same if lawsuits get granted the other side appeals to reverse it. That's why it's believed it will go to Supreme Court.
