Yea I thought the same thing. I think they stalled to collect as much evidence as possible and giving the courts less time to come to a decision therefore perhaps delaying the certification for the states. Which in the end could be more likliehood the SCOTUS steps in too. I don't know though im an 18 year with barely any knowledge on law.
I think this is part of their strategy because they need to bring as much to the table as they can for the main law suits.
