Normally they would penalize a plaintiff for leaving something out, but in this case I think there is a good chance a Judge permits an amended complaint, so long as its clear the information wasn't available earlier (and I think everyone knows how rushed everything is by necessity). Still, they need to make the best possible arguments they can at the beginning.
