Actually its breach of contract.

Imagine a man and a girl go to a baker and they guy say to the baker "I want that you create a cake for my wedding", the baker then says "congratulations you are a beautiful couple".

The guys says "she is my sister, I am getting married with my pet chicken" and the baker then says "Sorry, I am not going to make a cake under such circunstancies".

The baker is ok to do that, but he is not ok to say he is going to do the cake and at the wedding day, just say "I didnt done your cake". That would be a breach of contract.

When you enter a site, you expect they will follow their own rules, but they dont and they are breaking their own contract. At the case of websites, the situation is way worse than the baker one, not only they break their own contract but they create excuses for why they aren't doing that, to make sure no one sue them or leave (or not join) the site.

This happen when youtubers make videos saying "look at this new rule. youtube will be able to do X with us. I am scared." and then youtube says "you got the rule wrong" and then what the youtuber predicted it would happen, start to happen. They lied to youtubers to make sure they wont leave.

They ban stuff that is not against their terms of service, sometimes. And like I said with the youtube example, people interpret a terms of service update at some way and get scared, youtube say they are interpreting it wrongly but them do what those youtubers assumed youtube would do.

This is something that I think will need to make its way to court. Someone who is harassed by another user on Twitter or otherwise suffers harm due to an interaction on the platform needs to try suing Twitter, citing Ted's testimony and other evidence that Twitter is indeed a publisher and not a platform.

I believe that section 230 protections are "all or nothing" meaning you are either a platform or a publisher platform wide. You can't put a warning on one tweet and be a publisher but say another tweet falls under being a platform.

Victims need to go after Twitter, even if in small claims court, to get a precedent set. When Twitter comes back and says to the judge "We're protected by 230" it is up to the plaintiff to say no, you're a publisher, and here's why and present evidence of them acting like a publisher.

The key to stopping this is in the courts. Like I said, I think it's all or nothing, you don't have to prove they are a publisher within a specific Tweet thread, just that they are a publisher in some other instance which negates the platform protections for your cause of action.

Imagine if everyone who has suffered verbal abuse on Twitter sued them with examples of why they are a publisher and were able to collect for emotional trauma or for being cancelled / fired as a result of their Tweet.
