On top of that we have statements from last year that originated from Democrats in the Senate and House.

Higher courts always first try to establish they're not choosing a side in partisan disagreements. This is especially true for conservative and moderate judges.

This should be enough evidence to argue this is beyond any level of partisan squabble. The Democrats have made the same observations since Bush's second term.
