The argument being made by Jenna Ellis is far more likely to be taken seriously by the Supreme Court. Unfortunately, while we both earnestly believe Sydney Powell because of her excellent defense of General Flynn, allegations of systemic fraud would require a month-long trial. In order to toss the table by January, Powell would have to do more than just drop a lawsuit with affidavits and statistical evidence. She would need the DOJ working with her, preferably with access to the servers and machines.

That said, Jenna Ellis is arguing that 3-5 states violated the Constitition. We know for a fact that Democrats in Arizona, Michigan, Pennsylvania, Nevada and Wisconsin changed election rules without consulting with the legislative branch. Furthermore in most of those states, the legislative body is heavily Republican so there is good reason to believe in Michigan and Pennsylvania especially that they didn't agree with the changes.

My wife believes that if we can flip either Arizona, Nevada, Georgia or Wisconsin using a separate means, enough Republicans in Pennsylvania and Michigan could argue that the Democratic executive branch broke the Constitution's requirements. We believe 5 or even 6 of the judges on the Supreme Court would find that a sound argument. Michigan and Pennsylvania experienced numerous legal confrontations where Republican legislatures fought the executives before the election. Georgia and Arizona are harder to argue this case because the governors are Republican. Nevada has no Republican control. Wisconsin could also be lumped in with Michigan and Pennsylvania but we suspect the court would prefer to see the Republicans flip at least 1 state.

Governor Whitmer has completely ignored the legal demands of her legislature AND her courts. Pennsylvania's Democrats have barely acted better by only adhering to courts they agree with. If a 3rd state can be overturned, Republicans will have a rock solid case.
