The Electoral College votes on December 14. That's what really matters- and what determines who is sworn in on January 20, regardless of anything going on with the popular vote. Here's my understanding of the nuts and bolts of the process to get there:
When you vote in a presidential election, you aren't voting directly to seat a slate of electors. You're voting to tell your state legislature which slate of electors you want them to seat - the Republican slate or the Democrat slate, chosen by the state party delegates at their respective conventions.
First the popular vote gets certified by local election officials and the secretary of state. From there, it goes to the state legislature. They can vote to certify it (and therefore seat the slate of electors who the voters chose), or they can vote not to certify it, in which case the popular vote in that state is thrown out entirely and the legislature chooses their own slate of electors. This almost happened in Florida in 2000, but SCOTUS ruled for Bush on the same day that the Florida legislature was scheduled to vote.
All of the states the Trump team is contesting have Republican-controlled state legislatures. If the courts run out the clock, it will cast enough doubt on the results that those legislatures might vote against certifying the popular vote and move to seat their own slate of electors.
In Arizona and Georgia, there are also Republican Governors who would likely approve this move, bringing Trump's electoral vote total to 259.
Michigan, Wisconsin, Pennsylvania and Nevada have Democrat Governors who would not sign off on the legislatures' move to seat new electors. If the clock runs out in those states -no agreement reached between the Republican legislature and the Democrat Governor before December 14- then those states don't send electors.
That makes the electoral college vote total 259 Trump - 227 Biden. Because no one has 270, it goes to the House of Representatives, where a candidate needs the approval of 26 state delegations to win.
Stop counting on the legislatures to do this, in each of these states they are controlled by RINOs who hate Trump. Despite being constitutional, they will never send their own electors, if Trump hasn't got enough wins by then the rino republicans will not help him, it will be over.
In that event the congress chooses a temporary president and senate does so for a VP. Its complex and im not a US govt expert but there are hardcoded safeguards in the constitution.

Appellate courts as a rule don't permit new evidence without permission of the court. To get that permission you'll need a good reason why you couldn't introduce the evidence sooner.
In general (not just in appeals courts), ambushing the opposing party is a good way to get on a judge's bad side. Court isn't the place for playing games; that's what cable network legal dramas are for.

The judge (Brann) excluded claims and evidence based on Bognet v. PA in the 3rd circuit, and he has to stick by that precedent (That's the one Alito already had to step into).
If 3rd circuit interprets this case differently, and doesn't apply Bognet; or USSC throws Bognet under the bus, all that evidence comes into play once again.

If they get a precedent in the supreme court they'll be able to file equivalent lawsuits in all states and the judges won't be able to rule differently from SCOTUS. The legal team was quite careful not to specifically allege fraud. It's a much higher legal standard that must be proved to win a fraud case. The absolute proof of fraud that Giuliani and Powell have spoken about recently actually didn't fall into place until after this lawsuit was filed. Since the beginning I presumed that the reason for not alleging fraud was both evidentiary and strategic.
I can think of several reasons not to try a fraud case involving American-based voting machines in a federal district court. There would be no realistic way in presenting such a case that our enemies could be prevented from learning exactly how their fraud was discovered. You can be damn sure that any attempts to interfere in our future elections wouldn't make that same mistake. The entire case would need to be presented in a secure manner or it would need to be heard in a forum where the possibility of such security leaks could be eliminated.

Recall that a person of interest, if not THE main perp was supposedly not able to be located in the USA as of last week. All of the states the Trump team is contesting have Republican-controlled state legislatures. If the courts run out the clock, it will cast enough doubt on the results that those legislatures might vote against certifying the popular vote and move to seat their own slate of electors.
In Arizona and Georgia, there are also Republican Governors who would likely approve this move, bringing Trump's electoral vote total to 259.
Michigan, Wisconsin, Pennsylvania and Nevada have Democrat Governors who would not sign off on the legislatures' move to seat new electors. If the clock runs out in those states -no agreement reached between the Republican legislature and the Democrat Governor before December 14- then those states don't send electors.
That makes the electoral college vote total 259 Trump - 227 Biden. Because no one has 270, it goes to the House of Representatives, where a candidate needs the approval of 26 state delegations to win.
Republicans control 27. Trump wins.
Stop counting on the legislatures to do this, in each of these states they are controlled by RINOs who hate Trump. Despite being constitutional, they will never send their own electors, if Trump hasn't got enough wins by then the rino republicans will not help him, it will be over.

Appellate courts as a rule don't permit new evidence without permission of the court. To get that permission you'll need a good reason why you couldn't introduce the evidence sooner.
In general (not just in appeals courts), ambushing the opposing party is a good way to get on a judge's bad side. Court isn't the place for playing games; that's what cable network legal dramas are for.

New pede here... The judge (Brann) excluded claims and evidence based on Bognet v. PA in the 3rd circuit, and he has to stick by that precedent (That's the one Alito already had to step into). If 3rd circuit interprets this case differently, and doesn't apply Bognet; or USSC throws Bognet under the bus, all that evidence comes into play once again.

Dismissing with prejudice means this level court can never hear the case again. That means they either have to drop or appeal to a higher court. If it was dismissed without prejudice, they would have had to come back to this level of court again.
It just means they can't file the same issue in the circuit that judge is in. Nothing more. You can still appeal rulings. You can still request oversight.
No one cares about prejudice at this point because the same case is going to go up the chain and not be refiled in the same lower courts.

The issue with broadcasting the plans, is I'm guessing we will need 2 other states to make it to SCOTUS and now they'll know they need to run down the clock.
Thing is: a supreme court ruling CANNOT be overruled by a lower court. If they get a precedent in the supreme court they'll be able to file equivalent lawsuits in all states and the judges won't be able to rule differently from SCOTUS. That's why winning in the supreme court is best. Win there once and you win it all.

Yes, this is a concern for us. I've been trying to encourage people to put pressure on them, because politicians do respond to the threat of becoming insignificant and powerless. We don't need them to actually care; we just need them to do the right thing out of self preservation.
That's why it's so good that we're being loudly decisive about those who betray us- I promise that those politicians are looking at how thoroughly Fox got iced out overnight and including that in their calculations.

The legal team was quite careful not to specifically allege fraud. It's a much higher legal standard that must be proved to win a fraud case. The absolute proof of fraud that Giuliani and Powell have spoken about recently actually didn't fall into place until after this lawsuit was filed. Since the beginning I presumed that the reason for not alleging fraud was both evidentiary and strategic.
I can think of several reasons not to try a fraud case involving American-based voting machines in a federal district court. There would be no realistic way in presenting such a case that our enemies could be prevented from learning exactly how their fraud was discovered. You can be damn sure that any attempts to interfere in our future elections wouldn't make that same mistake. The entire case would need to be presented in a secure manner or it would need to be heard in a forum where the possibility of such security leaks could be eliminated.
There was a DOJ aircraft that flew to Toronto a few days ago. Dominion does have a large corporate presence there. Recall that a person of interest, if not THE main perp was supposedly not able to be located in the USA as of last week. If he were apprehended in Canada, you can do the math to figure out where jurisdiction could possibly be for a national security case. That is where Coomer would then be transported.
The next question that comes to mind is what is the most expedient way to make all of the current electors aware of the precise nature of the fraud and prove the fraud to their collective satisfaction that there would be no reasonable risk to Trump that the House would ensure his continued presidency.
According to Occam's razor and established procedure for national security cases, that is the path that this is going to follow during the next few weeks. There isn't much room beyond the constitution itself for how things will proceed

We're interested in making sure Biden doesn't get to 270. That's the goal. You dead lock the certs with injunctions.
You want to set precedent in the Supreme Court since all lower courts have to follow it. So if the SCOTUS says 'yeah, there's fraud, shits all fucked up, we need to put injunctions on all this shit', Then, when you start putting injunctions on everything, the precedent is already there and they don't have to waste time trying to convince judges all over the country.
Once you deadlock and injunction all of those states, no one gets 270, it goes to delegates, delegates vote by party lines, 28 R 22 D. It's done.
