I think it's actually Google/Android. I have Cricket, which is AT&T and I tested this the other day with friends. iPhone to iPhone on ATT seems to work.
Unless you have turned it off, iPhone to iPhone will be via iMessage, not SMS. That's sent over the network connection, and its encrypted in a way that even Apple cannot decrypt it.
However, if you backup your phone to iCloud, your iMessage history will be backed up and will be subject to a court order.
