Ultimately, the case is going to be made directly to the people that we are in the middle of a foreign coup to overthrow the United States and at that point we the people are going to have to decide how to proceed. If you are looking to state legislatures, congress or even the Supreme Court to decide this, you are looking in the wrong place.

They can't prove it in time.
They are victims of a disinformation effort.
