Semantics, but not really. The rights always exist, as they are natural rights that come from God.

The constitution just explicitly forbids government from infringing on those rights, but without people upholding their oath to it, it's only words on paper in effect.

Correct, this is th only way that the most effective tools to defend rights become justified. If "Rights" are only what you can defend (or have protected), then anything that you can muscle into reality is also a 'Right".
