Yeah, it sucks because the burden is on you to lawyer up, and then the company will just make up some bullshit about "His performance has been declining, we have coached him repeatedly on this" etc and back-date a paper trail. You could take out massive lines of credit and fund a legal battle, but the company likely has legal counsel already, it is a shit show.

If there is a plan to start something new, that's probably the move, even though OP is likely in the right and the company is in the wrong. The company would never go no the record saying they fired someone for contracting a virus, so OP would have an uphill battle.

After I called BS on their first 2 reasons (not getting tested on time, not wearing a contact tracing transmitter) they then said it was performance.

But I already formed an IT consulting company last year, I just don’t have any clients but now I’m starting a sunglasses business.

I also do standup comedy and have a podcast so I’m waiting for 1 of the 4 to make money.

if they say it's performance based then they need to show a documented history including performance reviews and corrective action plans given. California, right? dont waste the opportunity!

Dude, drop a link for your podcast, ill give it a listen. Also contact your states labor board and see if that company is in any violation. Its free and they will determine if it was wrongful termination, if it is then contact a lawyer
