This is correct. Robert Barnes (the uber election lawyer) has mentioned this many times. As long as the cancelled votes is greater than the margin of victory, the election result is in doubt and thus not valid.
I think even if it's close to the margin of victory but not quite over the top it might throw things into question. Especially if you can prove that ballots were destroyed or hijacked before they were counted.
