Pretty much this. There's an expectation of good faith. They've now come to suspect a client is breaking the law and they're contacting the police to review the evidence.

The FBI will probably cover it up but it's expected they'll shred whatever they're told to. At least they have names and purchase orders for who to blame for shredding evidence.

The only folks not doing their job seems to be the FBI.

And here's the other thing: why was the bin unlocked? Every one of those things I've seen has an embedded barrel lock in it (in this case a pad lock) for confidentiality. I'm pretty sure only the shredding company will have the keys for them; looks like it was left locked, but unfettered.

What happened in this video appears to be against the usual policy. Note I do not use A-1 but the company I do use is quite strict about this.

This is not how business is supposed to be done for shredders. That bin should have been locked instead of left unlocked, and the employee responsible for pickup should not have accepted it in that condition. Upon arrival at A1's facility it should have been unlocked and dumped directly into the shredder.

I don't necessarily think the company itself is to blame for any of this, except for (at a minimum) needing to set up better procedures and training to avoid this kind of thing. The employees themselves probably had no idea if those ballots were real or if they were just blank, unsent ballots—and honestly, neither do we. My instincts say that those were probably not blanks, and this was fraud all the way, but that doesn't mean the company was a party to the fraud.

They're supposed to be locked. If a shredding company is operating the way it's supposed to they shouldn't be accepting bins in that condition and employees should never lay eyes on the contents, except from a distance.

So several things are wrong here. A1 has some definite procedural issues but that doesn't mean the company itself or its employees are complicit in fraud. For those employees who did see ballots, unless they saw filled-out ballots they might have thought it was a stack of blanks. And if they did see filled-out ballots, they'd be put in a very difficult position where they'd be breaking the rules of their job if they reported it.

The thing is, if it is proven that they were given ballots to shred, this is in our favor. Destroying evidence implies guilt and judges will see it that way. Of course the judges could look the other way or be paid off or threatened, but in terms of evidence, them releasing this statement is a good thing regardless of whether or not they're just covering their own asses.

What's interesting about this statement is that it is completely unnecessary, unless you are trying to get in front of something. The paper shredding company is akin to a garbage collector, with no duty to inspect or know what's in the "trash" they are collecting. If you throw evidence in a trash can, the collector isn't going to be arrested or charged with destruction of evidence.

What this means is the shredding company was in the know somehow, and that there is evidence they knew what they would be shredding.

Not necessarily. What could have happened is that they shredded the document first, not realizing what they were, and then after seeing what was going on on social media, and putting 2 and 2 together, they got worried that they may have been duped into participating in a crime.

They might be completely innocent here.

Even if they figure it out after the fact that they may have been duped, there's no criminal liability in that scenario. Most crimes have an intent at time of crime component (knowingly, willingly, intentionally, wanton disregard), which you don't have in the after the fact scenario. Now, I don't know enough about the ballot procedures, so maybe you get criminal liability out of ignorance of the law (doing something illegal, not knowing it is illegal). I just see statements like these as javelin catching, which innocent people usually don't make.

This could also be a state difference, as here we have cases dealing with these common carrier entities and liability.

I worked for a shredding company. I def knew what I was shredding. Even after it’s been shredded I could tell where the paper was from. (Hospitals, lawyers office, etc.). Ballots would be easy to identify.

I used to work for one of these companies as a truck driver / shredder. We had special security dumpsters that we leased out to businesses around town that only we had the keys too. When the box was full we would drive on over to the business, hook the dumpster up to our truck, unlock the box and press a button. The whole dumpster goes inside the box and destroys everything leaving no evidence and the dumpster comes back out. You put the padlock back on and carry on with your day. Never once did I see any personal information, or have any idea what kind of information I was getting rid off. So in that regard these people are telling the truth, they probably didn't know what they were shredding.
