They have been playing games, they get sued in local courts who side with the governors, (local judges are often elected and controlled by party, especially if they are looking to move on to a higher court.) Then when the cases start moving to appeals court, and supreme court's, which can take time. They alter the rules rendering the cases moot, and the plantiffs wastes their money, and need to start over. The governors know time and money is on their side. This is what SCOTUS is addressing! It's very big, not just the freedom aspect, but also not letting the state governments hide with procedural games.
