I just spent the evening with a UK lawyer friend of mine while I picked his brains over a couple of beers about the process of setting up a charity here. He is in general practice now (down-shifting to a quieter life) but spent many years working for the Serious Fraud Office. Anyway, after we got business out of the way, I brought up the US election situation. I was BLOWN AWAY with his frankness. He said if he were Biden's attorney he would advise him to CONCEDE NOW while he can still do so whilst plausibly able to claim that he had no knowledge of the fraud committed. He said Biden's window of opportunity to get out of this mess without going to prison will close rapidly. The longer he leaves it the harder it will be to extricate himself. He said that if even 10% of what is being alleged can be proven then the entire structure around Biden will collapse in on itself. He likened it to complex corporate fraud cases. Once the lower operators and facilitators are caught out and arrested, the chain reaction of collapse brings the whole house of cards down. Once plea bargains enter the equation, the enterprise is doomed. They always sell out the next echelon above. He did qualify his remarks that he is trained in UK law rather than US law (although they share English Common Law roots) but his parting remark on the subject was perhaps the most telling: "Regardless of the legal system, I can recognize fraud when I see it!!!!"

Here's the thing. Concession is not part of the constitution. It's just a formality that typically happens when the winner has become obvious.

The Electoral college votes according to how their state went. This means even if Biden conceded. Trump would still have to press on to prevent the electors from certifying votes. Biden has to either:

  1. Admit publicly there was fraud and hope to get away with his skin in exchange for testimony. Which won't help because then they'll kill him.
  2. Press on and hope his lawyers can generate enough doubt as to his involvement to keep him out of prison.

I'm not sure I agree, if he concedes, then they can't force him to be president if their EC votes still swing that way. If he concedes out of the race then by default Trump is the winner.

If it was a boxing match and one fighter was pummeling the other guy and he was looking like he was going to win but then he say "Nah I give up", that'd be counted as a loss for him.

But it's not a boxing match. If he died, or otherwise withdrew they'd give it to Kamala. Trump would still not get the electoral votes necessary, so has to press on no matter what Biden does.
