I am not a lawyer, but here is my line of thought.
Election law isn’t the initial measure, it is a lawsuit where a preponderance of evidence can suggest fraud. It doesn’t even have to satisfy the “reasonable doubt” test.
Once evidence suggests fraud, and expert math / security witnesses testify (just like in a criminal case) then we move on to what general legal remedies and specific election remedies may exist within the law, whether they have ever been applied or not.
If a situation ( election officials or just human error) poisoned a batch, the batch needs to be thrown out. The argument here is that you disenfranchise good votes mixed with bad.
However, one bad vote cancels my vote and disenfranchises me (or someone).
The same outcome happens either way - someone is disenfranchised. So now Sidney must argue and the court must rule on on higher principle.
If someone is disenfranchised no matter what, we should look at the fraud and illegality to point towards who that would be.
If election officials created fraud and made it impossible to track valid and invalid votes, the clearest answer should be to invalidate the entire scope of jurisdiction, precinct or county. Or even state if the SoS is involved.

In GA, she is suing Kemp and Raffensperger directly. USC42 S1983 provides for individual and vicarious liability from what I can tell. This means that under the right circumstances, they can’t hide behind Qualified Immunity of the State. She made it personal, and can go after their direct assets.
Vicarious liability means they are also personally responsible for wrongdoing by anyone under their command or training programs.
A real lawyer needs to weigh in on this one, but I have seen this angle thrown around on legal websites for USC42 S 1983. Individual and vicarious liability.
It is tricky because if you could prove 10 ballots were fraudulent then does that mean the whole election should be nullified? It’s quite an extreme remedy and with this logic election in any state could be nullified.
Same goes for Rudy’s PA ‘ballot curing’ case. If a process issue in one county could nullify the election then in next time a Blue county in a Red state (or the opposite) can intentionally create a process issue to invalidate results.
So overall judges would like to see some hard evidence to justify such an extreme remedy. And NY Times data feed or some statistical data feed does not cut it, at least Rudy is not using it in his case.

Therefore I assume that the legal team will present enough evidence to warrant a court order to prevent certification by a state until the court makes its ruling. If that ruling doesn't happen in time for the electoral voting process and if enough states are affected, that will trigger a contingent election.

If you look at Mr Kallman’s case in MI - he asked for the certification to be put on hold to allowed audit, and the court dismissed it adding - you’ve got “compelling evidence” so go ahead and file a case proving fraud.

The ballot application asks you to list a mailing address (using P.O. box 123 is fine) and a residential address. Over 1000 people in Georgia found to be using a P.O. box as residence address. This could have been an innocent error except Matt says that these people used "Apartment 123" as the residential address - - trying to disguise the postal address as residential.

I am not a lawyer, but here is my line of thought.
Election law isn’t the initial measure, it is a lawsuit where a preponderance of evidence can suggest fraud. It doesn’t even have to satisfy the “reasonable doubt” test.
Once evidence suggests fraud, and expert math / security witnesses testify (just like in a criminal case) then we move on to what general legal remedies and specific election remedies may exist within the law, whether they have ever been applied or not.
If a situation ( election officials or just human error) poisoned a batch, the batch needs to be thrown out. The argument here is that you disenfranchise good votes mixed with bad.
However, one bad vote cancels my vote and disenfranchises me (or someone).
The same outcome happens either way - someone is disenfranchised. So now Sidney must argue and the court must rule on on higher principle.
If someone is disenfranchised no matter what, we should look at the fraud and illegality to point towards who that would be.
If election officials created fraud and made it impossible to track valid and invalid votes, the clearest answer should be to invalidate the entire scope of jurisdiction, precinct or county. Or even state if the SoS is involved.
This is the line of attack I would take. To make it worse, no one has picked up on the fact that she is filing this under USC42, Section 1983. This is the violation of civil rights act.
In GA, she is suing Kemp and Raffensperger directly. USC42 S1983 provides for individual and vicarious liability from what I can tell. This means that under the right circumstances, they can’t hide behind Qualified Immunity of the State. She made it personal, and can go after their direct assets.
Vicarious liability means they are also personally responsible for wrongdoing by anyone under their command or training programs.
A real lawyer needs to weigh in on this one, but I have seen this angle thrown around on legal websites for USC42 S 1983. Individual and vicarious liability.
It is tricky because if you could prove 10 ballots were fraudulent then does that mean the whole election should be nullified? It’s quite an extreme remedy and with this logic election in any state could be nullified.
Same goes for Rudy’s PA ‘ballot curing’ case. If a process issue in one county could nullify the election then in next time a Blue county in a Red state (or the opposite) can intentionally create a process issue to invalidate results.
So overall judges would like to see some hard evidence to justify such an extreme remedy. And NY Times data feed or some statistical data feed does not cut it, at least Rudy is not using it in his case.
So we need to go to court to gain access to the official logs but I'm sure that's part of the plan.

Therefore I assume that the legal team will present enough evidence to warrant a court order to prevent certification by a state until the court makes its ruling. If that ruling doesn't happen in time for the electoral voting process and if enough states are affected, that will trigger a contingent election.

The ballot application asks you to list a mailing address (using P.O. box 123 is fine) and a residential address. Over 1000 people in Georgia found to be using a P.O. box as residence address. This could have been an innocent error except Matt says that these people used "Apartment 123" as the residential address - - trying to disguise the postal address as residential.
