Well, it's better than having a delayed ruling where nothing is being ruled on and the clock is running out. But it would of course be best to obtain favorable rulings at the lower level so that the momentum is on your side. It's going to be interesting seeing how the Supreme Court handles this.

Whether SCOTUS decides to take this case shows whether Alito and the conservative judges are serious about fighting against the trampling of the constitution amidst this pandemic

Rudy is not afraid about statistics because he is doing the right thing. Sure his portofolio is going to say "fuck, I have so many instances were my cases were dropped". But just like Trump he would argue "don't misrepresent my image. My cases went to SCOTUS and I won there!". You can play the game of statistics in a wrong way.
