This was the same court that allowed the extension in the first place, got sent to SCOTUS, and ended in 4/4 back to lower court. We already had 4 justices that wanted to hear the case, now we have ACB. Relax. This was expected. This court is corrupt.

I'm just a moderate who comes here to understand Trump supporters opinions. I read Judge Bibas's ruling, all 21 pages of it. The complaint from the Trump Campaign is incredibly narrow. IE

Campaign lawyer Rudolph Giuliani conceded that the Campaign “doesn’t plead fraud.” Mot. to Dismiss Hr’g Tr. 118:19–20 (Nov. 17, 2020). He reiterated: “If we had alleged fraud, yes, but this is not a fraud case.” Id. at 137:18.

Their only allegation is that county variations in polling procedure led to the Trump campaign not being given the ability to observe the counting process. But the judge specifically says these claims were tossed because they never provide evidence that one campaign was treated differently from the other, just that there are county-level variations in vote observation procedure which is in accordance with the state law. They state again, on page 16 that the Trump Campaign specifically disavows any claims of fraud:

Here, however, there is no clear evidence of massive absentee-ballot fraud or forgery. On the contrary, at oral argument in the District Court, the Campaign specifically disavowed any claim of fraud. And the margin of victory here is not nearly as close: not 461 votes, but roughly 81,000.

Given the narrow scope of the argument, I'm sincerely curious to hear your thoughts on what could be achieved by taking this to the SCOTUS when two courts (I think?) have already decided the argument is invalid.

Actually, when I had time to let the food settle, this is not going to SCOTUS. Giuliani said, get the right case to SCOTUS, "right" was loaded, it means, not this case. This case was about a political action involving legislators, lends credence to the notion they cannot get a fair hearing. He knows exactly what he is doing. The case that goes to SCOTUS will be about the extensions that came about via SoS and Governor, overstepping the Legislators authority, and only if needed. It would seem that they know the PA Legislator is going to give them what they want. They would have to know, the number of votes they have in the State House is known well before its released in the public.

we'll see what happens in the next 72 hours what the SCOTUS will do with it.

i hope you are right that all 3 GOP judges are winking at us to send it to the SCOTUS rather than they rule for trump and then the dems delay by another week by making the whole circuit court hear it.

This won't really matter if the PA legislature does what PA Senator Doug Mastriano suggested he's doing on Bannon's War Room today, which is to take the case from the Sec of State and appoint pro-Trump electors. It also fast tracks the case to the Supreme Court, which is where it would have ended up anyway.

Negativity... reality.... the 2 are often intertwined. Realists help see a situation the way it really is, & that allows better planning. We don't want TD to be an echo chamber. I often disagree with Anaconda, but I often see his comments as useful, too. I agree with him completely on this. He made the right call.

This isn't a good sign. If Trump appointees and conservative judges are immediately scoffing and tossing the suit, why do we expect that SCOTUS won't do the same?

We need a couple of lower court wins to give te SCOTUS the balls to overturn even a fraudulent election. If we lose in all the lower courts the SCOTUS won't do it.
