I know what your going for OP but lets turn this in to a thought problem. does being pushed out of a helicopter violate the 8th amendment. "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."

So the first two parts of the 8th amendment don't apply, as we art setting bail or fines. the third part, nor Cruel AND unusual punishment inflicted, Might apply.

being forced to fall to ones death and see it coming and have no way to prevent it could be considered Cruel among a majority. but thats only one half of the sentance, is being tossed out of a hellicopter unusual. well yes, we have not done so in the past due to a lack of technology, hanging would be the closest one could compare it to and even that was quick and painless ( if done correctly) Falling from a helicopter would not be quick nor painless. as such it woudl be a violation of the 8th amendment.

now, per Federalist paper 84 and the constitution, Congress has the authority to decide what the punishment for treason is. and Congress could decide that a fireing squad is not "good enough" and that falling to ones death is much better, however this is VERY unlikely.
