I'm Cherokee and Choctaw living in Cherokee Indian Territory. I pay sales tax on everything I buy. If this plays out the worst it will be is I go to a store owned by a tribal member I will pay tax to a tribe. If I go to a store owned by non-tribal member I pay tax to the state. I work as a welder for a business owned by a non-tribal member on land that isn't owned by the tribe but resides in the territory, I will pay State and Federal Income Tax. There is almost 4 million people living in Oklahoma and only 10% or less are Indian. Again calm the fuck down and read the history and opinion written an understand why Gorsuch ruled the way he did. The treaties were violated and the legal remedy as it stands was to go this route. Treaties can be altered by Congress and Congress played a stupid game 120+ years ago and thought they could ignore the Constitution and we are reaping the bullshit for their fuckery. You don't like the Casinos, Tribal vehicle tags, or Hunting licenses? You don't like a group of people who are not paying the same taxes as non-tribal members? Take it up with Congress, they made the treaties they sued for peace. You can bullshit the rest of these people here and keep getting on the train bashing all Tribes of Indians because you know the place that happens to be about equal in size to the US called Europe? Yeah, they have how many ethnic and cultural groups across a similar land mass? How many bloody wars did they fight? Stop just reading snippets of history and realize everything is likely much more nuanced when both sides of history are told.
Look, we are not enemies. This isn't about me being mad at you. I understand why, from your point of view, you can't see why this is a big deal. But I work for the state and trust me, people that study this in the government are freaking out - the general public just hasn't caught up yet.
Just one of many examples - remember that pay raise we gave teachers a few years ago? That came from production tax (Oil and gas wells.) But now there's a question of who has the right to collect production tax. That will have a huge impact, not just on teachers, but on all the other state services that are paid for with the production tax.
Finally, I never bashed the tribes, I only pointed out the tribes aren't filled with indians. The tribes are whiter than america as a whole. It's primarily a bunch of mostly white people that have a government monopoly on gambling and sales tax and a strong lobby. Now they own half the state, and the non-tribe members will definately be affected by that. Tom Cole et. al., will do nothing to renegotiate the treaty because they get paid by the tribe. That's what we are dealing with.
I do apologize for coming out swinging, you aren't wrong that it will effect the State. Oklahoma fucked up just as much as the US Congress in this. The Tribes are corrupt and need to be cleaned up just as much as the state. The issue is that for 120 years laws were ignored and the Tribes tried to remove those fakes and blacks from our tribal rolls.
My blood is traceable on census and rolls past Cherokee Chief and Confederate General Stand Watie who was also cousins to John Ross neither were full blood Cherokee. My Choctaw side is traceable to 1810's Mississippi census. I'm only legally able to claim 1 tribe. So because my family wouldn't fuck their cousins after multiple major decreases to population to maintain full blood status, I should not be considered Cherokee or Choctaw?
I hope the State and the Tribes come to something that isn't a shit show but Oklahoma made this mess and they can clean it up.
My concern is that the federal government made the mess, and I doubt they will clean it up. The politics of it just don't allow it. Oklahoma is just along for the ride.
Another thought - depending on where you live, you may be in a worse position than I am. If you are indian you are subject to the jurisdiction of the tribe, EVEN IF IT ISN'T YOUR TRIBE. If live in another tribes territory you can't vote in their elections but they still have civil and criminal control over you. Taxation without representation. Apartheid.
