They might have been arrested because he was letting the people through after the charge instead of at the actual border. Now random unvetted people got into the country.
I am pretty sure it will be considered "Fraud", but since the guy paying for him is expecting to break the law, it will never be heard by a judge. So yeah, not at all illegal. But you dont want a bunch of illegals on the wrong side of the border wanting to kill you the next day they see you.
I shouldn't laugh but... Reminds me of the story of the guy that took parking fees in front of a Zoo for like 30 years and then one day didn't show up... the zoo never took parking fees and he retired a rich man somewhere.
